Ietekmētāji savā praksē plaši izmanto atsauksmes un ieteikumus, nereti balansējot uz negodīgas komercprakses aizlieguma pārkāpuma robežas, tāpēc ES likumdevējs ir pieņēmis Grozījumu direktīvu, kas tostarp iezīmē patērētāju atsauksmju un ieteikumu sniegšanas noteikumus un aizliedz nepatiesu vai sagrozītu patērētāju atsauksmju un ieteikumu sniegšanu. Tā kā Apskatāmais regulējums tika pieņemts sasteigti, tajā ir daudz neskaidrību. Bakalaura darba mērķis ir sniegt Apskatāmā regulējuma piemērošanai nepieciešamo interpretāciju, atklāt tā problēmjautājumus un piedāvāt risinājumus. Darba uzdevumi ietver Apskatāmā regulējuma pamatjēdzienu satura atklāšanu, EEZ valstu tiesu prakses un tiesībsargājošo iestāžu atzinumu izklāstu, praksē novērojamo situāciju analīzi. Bakalaura darbs atklāj “ietekmētāja” un autonomo jēdzienu “atsauksme” un “ieteikums” interpretāciju, kā arī kritiski un pozitīvi vērtējamos Apskatāmā regulējuma aspektus. Influencers make extensive use of reviews and endorsements, often balancing the breach of the prohibition of unfair commercial practices, so the EU legislator has adopted the Directive regulating, inter alia, the rules for submitting consumer reviews and endorsements and prohibiting false or misleading consumer reviews and endorsements. As the Regulation in question was adopted in a hurry, there is a lot of confusion. The aim of the bachelor's thesis is to provide the interpretation necessary for the application of the Regulation, to reveal its problematic areas and to offer solutions. The tasks of the study were to reveal the content of the basic concepts of the Regulation, to present the case law and the opinions of law enforcement authorities of the member states of EEA and to analyze the situations observed in practice. The bachelor's thesis reveals the interpretation of the “influencer” and the autonomous concepts of “review” and “endorsement”, as well as the critical and positive aspects of the Regulation.
