Procesa par noziedzīgi iegūtu mantu kā viena no sevišķā procesa veidiem kriminālprocesā tiesiskums zinātnisko publikāciju autoru vidū tiek vērtēts neviennozīmīgi, tomēr praksē tā piemērošana turpina pieaugt. Darbā analizēti tādi problēmjautājumi, kā, piemēram, procesa uzsākšanas lietderība, paziņojuma par pienākumu pierādīt mantas likumīgo izcelsmi nenosūtīšanas tiesiskās sekas, procesā piemērojamais pierādīšanas standarts un citi. Uzmanība pievērsta arī starptautiskās sadarbības jautājumiem un gaidāmajiem grozījumiem Kriminālprocesa likumā (Nr. 1323/Lp13), analizējot to atbilstību noteiktā mērķa sasniegšanai praksē. Darba rezultātā tostarp secināts, ka procesā par noziedzīgi iegūtu mantu var tikt piemēroti dažādi pierādīšanas standarti, tāpat, konstatējot tiesiskā regulējuma trūkumus, sniegti priekšlikumi tā pilnveidei. The legitimacy of the proceedings regarding criminally acquired property as one of the special processes in criminal proceedings among the scientific publications authors is ambiguous, however, in practice its application continues to grow. This thesis analyzes such issues as, for example, the efficiency of initiating the proceedings, legal consequences of failure to send a statement regarding the obligation to prove the legal origin of the property, the standard of proof applicable in the proceedings and others. Attention is also drawn to the issues of international co-operation and the forthcoming amendments to the Criminal Procedure Law (No. 1323/Lp13), analyzing their relevance to achieving the stated objective in practice. As a result of the research, it has been concluded, among other things, that different standards of proof may be applied in the proceedings regarding criminally acquired property, as well as, identifying the shortcomings of the regulatory framework, proposals for its improvement have been made.
