Nosacīta pirmstermiņa atbrīvošana no soda

Abstract

Ja personai tiek piemērots brīvības atņemšanas sods, tas nenozīmē to, ka personai ieslodzījuma vietā būs jāpavada viss piemērotais brīvības atņemšanas sods pilnībā. Krimināllikums paredz nosacītu pirmstermiņa atbrīvošanu no soda. Tā var tikt piemērota ieslodzītajiem, kas ir izcietuši konkrētu daļu no noteiktā brīvības atņemšanas soda, kā arī ir ievēroti pārējie Krimināllikumā, Latvijas Sodu izpildes kodeksā u.c. normatīvajos aktos norādītie priekšnoteikumi. Jāņem vērā, ka tiesai nav pienākums personu nosacīti atbrīvot no soda pirms termiņa. Maģistra darba mērķis ir izpētīt nosacītas pirmstermiņa atbrīvošanas priekšnosacījumus, tiesu praksi kādos gadījumos apmierina vai noraida notiesātās personas iesniegumu par nosacītu pirmstermiņa atbrīvošanu no soda, procesuālo kārtību nosacītai pirmstermiņa atbrīvošanai no soda, atbrīvoto personu uzraudzību, salīdzināt nosacītas pirmstermiņa atbrīvošanas institūtu ar ārvalstu normatīvajiem regulējumiem, kā arī iespējams konstatēt problēmjautājumus normatīvajā regulējumā un tiesu praksē. Maģistra darbā tiek ieteikts veidot vienveidīgu tiesu praksi, jo šobrīd ir saskatāmas atšķirības iesniegumu par nosacītu pirmstermiņu atbrīvošanas no soda apmierināšanu vai noraidīšanu gadījumos, kad izpildās visi nepieciešamie priekšnosacījumi, kā arī ieteikums likuma grozījumiem, kas paredzētu lēmumu pārsūdzēšanu pēc būtības.

If a person is sentenced to imprisonment, that does not mean that the person will have to spend the full custodial sentence in imprisonment. The Criminal Code provides possibility to conditional pre-term release. The possibility to release from complete sentence person, who has served a certain part of punishment, as well as the rest of the Criminal Code, Penal Code, etc. the preconditions specified in regulatory enactments. It should be noted that the court is not obliged to release a person conditionally from the sentence before the term. The aim of the master's thesis is to explore the preconditions for conditional pre-term release, different sentences in which cases satisfies or rejects a convicted person's possibility to conditional pre-term release, procedural procedures for conditional pre-term release, supervision of released persons, to compare the institute of conditional pre-term release, with foreign regulations, as it is also possible to identify problematic issues in the regulatory framework and case law. In the master's thesis is recommended to create a uniform cese law, because at present there are differences in the cases for satisfaction or rejection of conditional pre-term release, when all the necessary preconditions are accomplished, as well as a recommendation for amendments to the law, which would provide for appealing against decisions on the merits.
