Darba devēja tiesiskās aizsardzības līdzekļi darbinieka negodprātīgas rīcības gadījumā

Abstract

Pastāv uzskats, ka darba devējs tiesiski ir pasargāts un nodrošināts ar skaidri saprotamiem tiesiskās aizsardzības līdzekļiem, bet darbinieks tiek uzskatīts par neaizsargātāko un vājāko pusi. Lai arī darbinieku tiesiskajai aizsardzībai ir jāpievērš liela uzmanība, nedrīkst aizmirst arī par darba devējiem, kuri nereti cieš no darbinieku negodprātīgas rīcības. Darba gaitā tiek pētīti tiesiskās aizsardzības līdzekļi gan Latvijā, gan ārvalstīs- Vācijā, Polijā un Kanādā, kā arī rasti priekšlikumi Latvijā spēkā esošā normatīvā regulējuma grozījumiem, lai piedāvātu pēc iespējas skaidrāku un pilnīgāku tiesību normu formulējumu. Darba kopējais apjoms ir 72 lappuses.

There is an opinion that the employer is legally protected and provided with clearly understandable resources, while the employee is considered to be the most vulnerable and weaker party. While the legal protection of workers needs to be given great attention, employers who often suffer from dishonest conduct by employees must also not be forgotten. In the course of research, legal resources are being studied both in Latvia and abroad- Germany, Poland and Canada- as well as proposals for amendments to the regulatory framework currently in force in Latvia have been made to offer clearer and more complete wording of the legal norms. Total amount of the research is 72 pages.
