Maģistra darba mērķis ir izpētīt, vai, krimināllietu izskatot rakstveida procesā, tiek ievērotas tiesības uz taisnīgu tiesu. Mērķa sasniegšanai tika izpētīts taisnīgas tiesas principa saturs kriminālprocesā, rakstveida procesa regulējuma vēsturiskā attīstība, analizēta Latvijas un Eiropas Cilvēktiesību tiesas tiesu prakse un izpētīta taisnīgas tiesas principa elementu mijiedarbība. Darbā secināts, ka rakstveida procesā tiek stimulēts procesuālās ekonomijas princips, bet ierobežots mutiskuma, atklātuma un līdztiesības princips, turklāt novērojama negatīva ietekme uz pierādījumu un tiesas objektivitātes izvērtēšanu un soda noteikšanu. Konstatēts nepamatots mutiskuma principa ierobežojums Covid-19 infekcijas izplatības pārvaldības likums 12.panta pirmajā daļā. Atslēgvārdi: taisnīga tiesa, rakstveida process, mutiskums, krimināllietas iztiesāšana The aim of the master's thesis is to study compliance of fair trial in a criminal case using a written procedure. In order to achieve this aim, the content of the principle of a fair trial in criminal proceedings, the historical development of the regulation of written procedure, the case law of Latvia and the European Court of Human Rights and the interaction with the basic elements of a fair trial were analyzed. Thesis concludes that the principle of procedural economy is stimulated in the written procedure, but the principles of oral hearing, publicity and equality are limited, and a negative impact on the assessment of the impartiality of the court and on determining the penalty. It was found that an unjustified restriction of the oral hearing has been established in Article 12 (1) of the Law on the Management of the Spread of COVID-19 Infection.
