Maģistra darbs veltīts tēmai par problemātiku lietās par izmaksām no Ārstniecības riska fonda, kur saistībā ar pacientiem sniegtajiem ārstniecības pakalpojumiem ir nodarīts kaitējums dzīvībai vai veselībai, vai radīts materiāls kaitējums. Maģistra darba mērķis ir identificēt problemātiskos jautājumus lietās par izmaksām no fonda, kas ir saistīti ar Pacientu tiesību likuma 16.panta pirmajā daļā iekļautajiem priekšnoteikumiem atlīdzības izmaksai – kaitējums, ārstniecības personas darbība vai bezdarbība un cēloņsakarība, un piedāvāt priekšlikumus problēmjautājumu risināšanai un normatīvā regulējuma pilnveidei. Darba rezultātā noskaidrots, ka, vērtējot priekšnoteikumu esību, izmantojami tādi principi kā pieredzējuša speciālista darbības standarts un cēloņsakarības iespējamības pārsvars. Noskaidrots, ka atlīdzības pieprasīšanai noteikts nepamatoti īss termiņš un tiesiskais regulējums neaptver visus kaitējuma veidus, par kuriem ir iespējams saņemt atlīdzību. Attiecībā uz konstatētajām problēmām, darba rezultātā piedāvāti priekšlikumi problēmu risināšanai un normatīvā regulējuma pilnveidei. The master's thesis is dedicated to the topic of the problematic case of costs from the Medical risk fund, which is related to the provided medical service and damage to life or health, or damage to the material created. The aim of the Master's thesis is to identify problematic in cases, which are related to the prerequisites for the payment of compensation included in the first part of Article 16 of the Law on Patients' Rights - damage, action or inaction of the medical practitioner and causation, and to offer suggestions for solving problems and improving the regulatory framework. As the result of this thesis, it was clarified that principles such as the standard of operation of the an experienced specialist and the preponderance of the possibility of causation should be used to determine the existence of prerequisites. It has been clarified that compensation can be requested in an unreasonably short period of time and the legal framework does not cover all types of damage for which it is possible to receive compensation. As the result of the work, are offered suggestions for solving problems and improving the regulatory framework.
