Paternitātes noteikšana, tās apstrīdēšanas subjekti un termiņi

Abstract

Bakalaura darba mērķis ir novērtēt paternitātes noteikšanas un apstrīdēšanas regulējuma atbilstību mūsdienu sabiedrības vajadzībām. Darba uzdevumi: apzināt paternitātes noteikšanas veidus un apstrīdēšanas institūtu, izpētīt to vēsturisko attīstību, salīdzināt citu valstu normatīvo regulējumu ar spēkā esošo regulējumu Latvijā. Darba autore secina, ka spēkā esošais regulējums attiecībā uz paternitātes noteikšanu un apstrīdēšanu ir nepilnīgs, apdraud bērna tiesības uz identitāti un stabilu ģimenes vidi. Tiek piedāvāti un pamatoti grozījumi Civillikuma 146., 149., 155., 156., 399. pantā un Civilprocesa likuma 246., 247., 249. pantā.

The aim of this bachelor thesis is to evaluate the conformity of the regulation on determining and contesting paternity to the needs of modern society. Terms of reference: to identify the methods of determining paternity and the institution of contestation, to study their historical development, and to compare the regulatory frameworks of other countries with the existing regulation in Latvia. The author of the thesis concludes that the current regulation regarding the determination and contestation of paternity is incomplete and endangers child’s right to identity and a stable family environment. The author of the thesis proposes and justifies amendments to Sections 146, 149, 155, 156, and 399 of the Civil Code and Sections 246, 247, 249 of the Civil Procedure Law.
