Politikas ietekme tiesībās: elektroenerģijas ražošanas no atjaunojamiem energoresursiem regulējums Latvijā 21. gadsimta sākumā

Abstract

Bakalaura darba “Politikas ietekme tiesībās: elektroenerģijas ražošanas no atjaunojamiem energoresursiem regulējums Latvijā 21. gadsimta sākumā” mērķis ir apskatīt elektroenerģijas, kas ražota no atjaunojamiem energoresursiem, atbalsta regulējuma Latvijā attīstību, izanalizēt tā izstrādes kontekstu, kā arī izpētīt politikas ietekmi tajā. Augstākminētais regulējums Latvijā ir politizēts un tas ir radījis problēmu virkni. Šobrīd, kad enerģētikas, ekonomikas un ģeopolitisko sarežģījumu dēļ pastiprināta uzmanība tiek pievērsta atjaunojamiem energoresursiem un notiek enerģētikas regulējuma jaunrade, ir būtiski izvērtēt jau esošā regulējuma attīstības gaitu un tā izstrādes kontekstu, lai novērstu kļūdas turpmāk. Pētījumā secināts, ka politikas ietekmes dēļ elektroenerģijas, kas ražota no atjaunojamiem energoresursiem, atbalsta regulējums Latvijā ir bijis nepilnīgs, problemātisks, un savu mērķi nesasniedza. Šī regulējuma izstrādē lielāks uzsvars tika likts uz politiskiem, nevis tehniskiem vai ekonomiskiem apsvērumiem, un no šādas situācijas likumdevējam būtu jāizvairās, izstrādājot jaunu regulējumu enerģētikas nozarē.

The goal of the bachelor thesis “Influence of politics in law: the regulation of electricity generation from renewable energy sources in Latvia in the beginning of the 21st century” is to review the development of the regulation on support to electricity which is generated from renewable energy sources in Latvia, and to analyse its development context and the influence of politics in it. The above-mentioned regulation in Latvia is politicized and it has caused a variety of problems. Now, when due to energy market, economic and geopolitical issues increased attention is put towards renewable energy sources and development of new energy sector regulation takes place, it is important to assess the development and its context of the existing regulation in order to avoid mistakes in the future. This study concludes that due to influence of politics the regulation on support to electricity which is generated from renewable energy sources in Latvia is incomplete, problematic and has not achieved its goal. During the development of this regulation, more weight was put on political, rather than technical or economic considerations, and the legislator should avoid this situation in the future when developing new regulation for the energy sector.
