dc.description.abstract | Ikvienai sabiedrībai ir jāsaskaras ar vajadzību pēc drošības, ko visbiežāk sasniedz ar bruņoto spēku darbības nodrošināšanu. Bruņoto spēku karavīriem bieži vien ir stingrāki tiesību ierobežojumi nekā citiem civiliedzīvotājiem. Tas rada nepieciešamību līdzsvarot valsts drošības aizsardzību ar personas cilvēktiesībām. Kā šīs vērtības saduras attiecībā uz aizliegumu militārām personām būt politiski aktīvām, t.sk. iesaistīties politiskās partijās? Bakalaura darba “Aizliegums militārām personām būt politiskās partijās” ietvaros tiek samērotas valsts drošības intereses un karavīru tiesības piedalīties valsts politiskajos procesos, uzsverot tieši vārda un pulcēšanās un biedrošanās brīvību ierobežojumus, analizēts ierobežojumu samērīgums. Darbā vērtēta aizlieguma būt politiskās partijās piemērotība tiesiskajai realitātei Latvijā, izvirzītas tēzes par atbilstību ECT tiesu prakses atziņām un tās norādītajiem kritērijiem, norādīta iespējamā problemātika un izvirzīti priekšlikumi. | |
dc.description.abstract | Every society is confronted with the need for security, which is most often achieved through the operation of the armed forces. Members of the armed forces are often subject to stricter rights restrictions than other civilians. This creates a need to balance the protection of national security with individual human rights. How do these values collide in relation to the prohibition on military persons being politically active, including joining political parties? Bachelor’s thesis "Prohibition for military persons to engage in political parties" balances the interests of national security and the right of soldiers to participate in the political processes of the country, focusing specifically on restrictions on the freedoms of expression and assembly and association, and analyses the proportionality of the restrictions. The thesis assesses the suitability of the ban on membership in political parties to the legal reality in Latvia, puts forward theses on the compliance with the ECHR case law and the criteria it indicates, points out possible problems and puts forward proposals. | |
