Latvijas Universitātes studenta Matīsa Vaita bakalaura darbs “Sacīkstes princips un procesuālās ekonomijas princips, to mijiedarbība praksē”. Bakalaura darba mērķis ir noskaidrot sacīkstes principa un procesuālās ekonomijas principa tvērumu un nepieciešamās robežas tiesību uz taisnīgu tiesu nodrošināšanai. Mērķa sasniegšanai darba autors izpētīja šo principu jēdzienisko izpratni, vēsturisko izcelšanos un piemērošanu praksē. Tika apskatītas sacīkstes principa un procesuālās ekonomijas principa pozitīvās un negatīvās iezīmes, savstarpējā mijiedarbība un prakse pierādījumu iesniegšanā, rakstveida procesā un Covid-19 izplatības ierobežošanas regulējumos. Autors secina, ka taisnīgu tiesu iespējams nodrošināt vienīgi katrā situācijā piepildot sacīkstes principa un procesuālās ekonomijas principa mērķi, ar esošās situācijas apstākļiem, tomēr praksē vērojams pārlieku liels formālisms, vadoties pēc likuma burta un neņemot vērā šo principu garu, kas noved pie novilcinātas un netaisnīgas lietas izskatīšanas. Bachelor’s work of University of Latvia student Matīss Vaits “Adversarial principle and principle of procedural economy, their interaction in practice”. The aim of the bachelor’s work is to clarify the scope of the adversarial principle and procedural economy principle and the necessary limits to ensure the right to a fair trial. To achieve this goal, the author of the bachelor’s work explored the conceptual understanding, historical origins, and application of these principles in practice. The positive and negative characteristics of the of adversarial principle and the principle of procedural economy, their interaction, and the practice of presenting evidence, written proceedings, and COVID-19 containment regulations were examined. The author concludes that a fair trial can only be ensured by fulfilling the objectives of the adversarial principle and the principle of procedural economy in each situation, taking into account the circumstances of the specific case. However, excessive formalism is observed in practice, where the letter of the law is followed without considering the spirit of these principles, leading to delayed and unjust handling of cases.
