Mobings darba vietā Latvijas tiesību sistēmā ir salīdzinoši jauns termins un tāpat kā lielā daļā citu Eiropas Savienības dalībvalstu, arī Latvijas normatīvie akti nesatur tiešu mobinga regulējumu. Jēdzienu “mobings darba vietā” ar saturu piepilda tiesas, izskatot darba strīdus. Absolūti lielākajā daļā tiesvedību tiek konstatēta mobinga neesamība. Pētījumā “Mobinga un bosinga darba vietā izpratne Latvijas tiesu praksē un doktrīnā” autore noskaidros, kādi tiesiskā regulējuma trūkumi ierobežo darbinieka tiesības uz savu aizskarto tiesību un interešu aizsardzību taisnīgā tiesā. Pētījuma ietvaros tiks konstatēts, ka tiesvedību iznākumi liecina par jēdziena “mobings” izpratnes trūkumu, pierādīšanas problemātiku strīda gadījumā, kā arī identificēti darbinieka un citu darba attiecībās iesaistīto personu tiesību uz aizskarto tiesību un interešu aizsardzību taisnīgā tiesā ierobežojumi. Pētījuma noslēgumā ietverti priekšlikumi tiesiskās aizsardzības pilnveidei tiesību aizskāruma gadījumā, kas izpaudies mobinga formā. Mobbing in the workplace is a relatively new term in the Latvian legal system and, as in a large part of other European Union Member States, the laws and regulations of Latvia do not contain direct regulation of mobbing. The concept of "mobbing in the workplace" is filled with content by courts when considering labor disputes. In the absolute majority of legal proceedings, the absence of mobbing is found. In the study "Understanding of mobbing and bossing in the workplace in Latvian case law and doctrine", the author finds out what shortcomings of the legal framework limit the right of an employee to the protection of his violated rights and interests in a fair trial. The study will find that the outcome of the proceedings indicates a lack of understanding of the concept of "mobbing", the problem of proof in the event of a dispute, as well as indentified restrictions on the right of the employee and other persons involved in the employment relationship to the protection of the rights and interests of the infringed in a fair court. The study concludes with proposals for improving legal protection in case of violation of rights, which has manifested itself in the form of mobbing.
