Atbildība par pornogrāfiska rakstura materiālu apriti

Abstract

Maģistra darbs ir saistīts par atbildību par pornogrāfiska rakstura materiāla apriti. Tā mērķis ir aplūkot Krimināllikuma 166.panta vēsturisko attīstību līdz mūsdienām, noskaidrot pornogrāfijas definīciju, analizēt noziedzīgā nodarījuma sastāvu, tiesu praksi, ārvalstu regulējumu par šāda veida apriti un mūsdienu aktualitātes Latvijā. Pornogrāfiska rakstura materiālu uzskaitījums ir plašs, kā arī tā aprite var izpausties dažādos veidos. Vērtējot vēsturisko gaitu, kāds pienesums ir nācis klāt un kā aprites veidi ir izmainījušies, kā arī vērtējot citu valstu regulējumus, kurās iztrūkst būtiski aizliegumi atsevišķiem pornogrāfiska rakstura materiāliem, likumdevējam Latvijā ir veiksmīgi izdevies noregulēt šādu aspektu. Autors norāda, ka nav vienotas koncepcijas par pornogrāfijas nozīmi, kas var radīt problēmsituācijas atsevišķās situācijās.

The master's thesis is related to the responsibility for the circulation of pornographic material. Its aim is to look at the historical development of Section 166 of the Criminal Law to the present day, to clarify the definition of pornography, to analyze the composition of a criminal offense, court practice, foreign regulation on this type of circulation and current issues in Latvia. The list of pornographic materials is extensive, and its circulation can take many forms. Assessing the historical course, what contribution has been made and how the types of circulation have changed, as well as assessing the regulations of other countries where there are significant bans on certain pornographic materials, the Latvian legislator has successfully managed to regulate such an aspect. The author points out that there is no common concept about the meaning of pornography, which can lead to problematic situations in certain situations.
