Bakalaura darbā “Administratīvo resursu izmantošanas aizliegums: pašvaldību informatīvie izdevumi” autore izpēta pašvaldības finanšu līdzekļu un mantas izmantošanas priekšvēlēšanu aģitācijai aizlieguma teorētiskos un praktiskos jautājumus, fokusējoties uz tā izpausmi pašvaldību informatīvajos izdevumos. Lai piemērotu atbildību par administratīvo resursu izmantošanas aizlieguma pārkāpumu nepieciešams noskaidrot: 1) vai aģitācijas periodā kāda no publikācijām pašvaldības informatīvajā izdevumā uzskatāma par priekšvēlēšanu aģitāciju; 2) vai šo publikāciju sagatavošanai izmantoti pašvaldības administratīvie resursi; 3) pašvaldības amatpersonu vai darbinieku, kura prettiesiski izlietojusi pašvaldības administratīvos resursus priekšvēlēšanu aģitācijas veikšanai. Bakalaura darbā aplūkoti problēmjautājumi par katru no minētajiem atbildības priekšnoteikumiem. Tāpat analizēti teorētiskie un praktiskie aspekti, kas attiecas uz administratīvā akta, ar kuru uzlikts pienākums atlīdzināt valstij nodarītos zaudējumus, izdošanu. Autores veiktais pētījums ļauj secināt, ka patlaban spēkā esošais Priekšvēlēšanu aģitācijas likuma 33. panta un 34. panta regulējums ir nepilnīgs. Šīs tiesību normas pilnveidojamas, nosakot konkrētu administratīvās atbildības subjektu, kā arī uzraugošajai iestādei nosakot rīcības brīvību administratīvā akta izdošanas gadījumā. Tāpat secināts, ka normatīvajā regulējumā, papildus esošajam administratīvo resursu izmantošanas aizliegumam, jāiekļauj aizliegums veikt priekšvēlēšanu aģitāciju pašvaldības informatīvajā izdevumā. In bachelor thesis “Prohibition of the Use of Administrative Resources: municipal newsletters” the author examines and assesses the theoretical and practical issues of the prohibition of the use of municipal financial resources and property for pre-election campaigning, focusing on its manifestation in municipal newsletters. In order to impose liability for violation of the prohibition on the use of administrative resources, it is necessary to establish: 1) whether any of the publications in the municipality's newsletter during the campaign period constitutes pre-election campaigning; 2) whether the municipality's administrative resources were used to prepare these publications; 3) the municipality official or employee who unlawfully used the municipality's administrative resources to carry out pre-election campaigning. The bachelor thesis deals with the issues concerning each of the above mentioned prerequisites of liability. The theoretical and practical aspects of issuing an administrative act imposing an obligation to compensate the state for damages suffered by the municipality are also analysed. The author's research leads to the conclusion that the current regulation of Articles 33 and 34 of the Law on Pre-election Campaigning is incomplete. These legal norms should be improved by defining a specific subject of administrative liability and also by giving the supervising authority discretion in case of issuing an administrative act. It is also concluded that the regulatory framework should, in addition to the existing prohibition on the use of administrative resources, include a prohibition on electioneering in the municipal newsletter.
