Aizgādības tiesību attīstības un pārtraukšanas analīze

Abstract

2022. gadā bērna aizgādības tiesības tika pārtrauktas 983 vecākiem, 1202 bērnus šķirot no vecākiem. Statistikas dati norāda uz aizgādības tiesību pārtraukšanas aktualitāti Latvijā, tādēļ autore vēlas, izpētot pastāvošo procesu, sniegt ierosinājumus aizgādības tiesību pārtraukšanas procesa pilnveidošanai. Aizgādības tiesību pārtraukšanas process kopumā ir efektīvs, tomēr ir iespējami uzlabojumi, lai nodrošinātu pienācīgu bērnu tiesību aizsardzību, mazinot gadījums, kad bērni ir šķirami no ģimenes. Nepieciešams uzsvērt bērna emocionāli veselīgas vides nodrošināšanu, kā arī izveidot vadlīnijas, lai varētu efektīvāk konstatēt emocionālās vardarbības faktu, kas praksē ir sarežģīti konstatējama, kā arī ir jāveic citi pilnveidojumi procesā, kas ir apskatīti šajā darbā.

In 2022, 983 parent had their child custody rights terminated and 1202 children were separated from their parents. Statistical data indicate that termination of custody is relevant issue in Latvia, and the author would like to make suggestions for improving the process of termination of custody by examining the existing process. The process of termination of custody is effective, but there is room for improvement to ensure proper protection of children’s rights by reducing the number of children separated from their families. It is necessary to emphasise the provision of an emotionally healthy environment for the child and to establish guidelines to allow for a more effective detection of emotional abuse, which is difficult to detect in practice, as well as other improvements in the process, which are discussed in this study.
