Ar nekustamo īpašumu saistīto tiesību nostiprināšanas zemesgrāmatā aktualitātes un problemātika

Abstract

Autore savā darbā izpēta tēmu „Ar nekustamo īpašumu saistīto tiesību nostiprināšanas zemesgrāmatā aktualitātes un problemātika”. Šajā darbā tiek veikts ieskats zemesgrāmatu darbībā laika periodā no zemesgrāmatu rašanās pirmsākumiem līdz mūsdienām un cik liela loma tiek piešķirta zemesgrāmatu darbībai. Bakalaura darba mērķis ir izpētīt esošās problēmas, ar kādām saskaras fiziskas un juridiskas personas nostiprinot īpašuma tiesības zemesgrāmatā, kā arī iepazīstoties ar zemesgrāmatu nodalījuma saturu. Galvenais uzdevums bija atrast nepilnības ar nekustamā īpašuma reģistrācijas procesu saistītajā zemesgrāmatu darbībā un dot tām pēc autores domām vispieņemamākos risinājumus, kā šīs nepilnības varētu novērst un uzlabot šīs sfēras darbību. Kā uzdevumus bija kopumā izprast aktuālās problēmas, kas saistītas ar valsts nodevas piemērošanu par tiesību nostiprinājumiem zemesgrāmatā, izprast zemesgrāmatu nodalījuma nepilnības un piedāvāt konkrētus normatīvo aktu grozījumu priekšlikumus, kas atvieglotu personām nekustamā īpašuma ierakstīšanas un ar to saistīto tiesību nostiprināšanas zemesgrāmatā procesus/ veikt darbības. Galvenie ieguvumi no problēmu risinājumiem ir uzlabota tiesiskā vide nekustamo īpašumu darījumu jomā, pilnveidota datu apmaiņa ar citām informācijas sistēmām, pārskatāms, aktuāls zemesgrāmatu nodalījums, pārskatāmi valsts nodevas samaksas subjekti un precizēts valsts nodevas objekts, vienkāršota, elektroniska nostiprinājuma lūgumu iesniegšana zemesgrāmatā.

The author in the bachelor paper explores the theme "Actualities and Problems Related to Rights Corroboration of the Immovable Properties into the Land Registers". In the paper has shown the insight of the Land Registry operation in the time period from its beginnings to the present days and how big role is given to the operation of the Land Registry. The aim of the bachelor paper is to examine the existing problems faced by natural and legal persons by strengthening property rights in the Land Registry, as well as get acquainted with the contents of the Land Registry compartments. The main task was to find weaknesses in the real estate registration process related to the operation of the Land Registry and give them by the author considers the most reasonable solutions how these shortcomings could be avoided and to improve its current operations. The tasks were generally understand the current problems related to the application of state fee for the reinforcement the rights in the Land Registry, to understand the gaps and offer concrete proposals for amendments to laws and regulations in order to facilitate the recording of real estate entities and reinforcement the related rights in the processes / take action of the Land Registry. The main benefits is improved the legal environment in the real estate business sphere, improved data exchange with other information systems, transparent, topical Land Registry, transparent state fees holders and specifies the object of the state fees, simplified electronic registration request submission in the Land Registry.
