Diplomdarba tēma ir „Tehniski bojātu transportlīdzekļu laišana ekspluatācijā”, un šis noziedzīgais nodarījums ir ietverts Krimināllikuma 263.pantā. Darba mērķis ir padziļināti analizēt, kas ir tehniski bojātu transportlīdzekļu apzināta laišana ekspluatācijā un citādu to ekspluatācijas noteikumu pārkāpšana, kā arī izpētīt šī noziedzīgā nodarījuma sastāva lietderību. Diplomdarba pirmajās divās nodaļās ir analizētas objektīvo un subjektīvo pazīmju kopums noziedzīgos nodarījumos par tehniski bojātu transportlīdzekļu laišanu ekspluatācijā.
Apskatot tiesu praksi Latvijā, redzams, ka lielākā daļa spriedumu ir par pieļaušanu vadīt transportlīdzekli personai, kurai nav vadītāja tiesību vai tās ir atņemtas. Attiecībā uz nodarījumiem, kas saistīti ar tehniski bojātu transportlīdzekļu laišanu ekspluatācijā, tad šie gadījumi tiek konstatēti ļoti reti. Aplūkojot šī nodarījuma regulējumu ārvalstīs, darba trešajā nodaļā, redzams, ka Krimināllikuma 263.panta ietvertais noziedzīgais nodarījums ļoti lielā daļā Eiropas valstu nav kriminalizēts, tieši tāpat ir rīkojušās Igaunija un Lietuva, kas nav iekļāvušas šo normu jaunajos kriminālkodeksos. Diplomdarba noslēgumā ir apkopoti atzinumi un secinājumi par darba gaitā gūtajām atziņām, kā arī ir sniegti priekšlikumi attiecībā uz to regulējumu Krimināllikumā. The theme of diploma paper is „Technically defective vehicles letting into exploitation”, and this crime has included into Criminal Law, article No 263. The aim of the paper is deeper analyzing, what is wittingly letting into exploitation of technically defective vehicles and breaching of other its exploitation conditions, as well as investigates the usefulness of this crime structure. In the first two parts of the diploma paper there is analyzed the totality of objective and subjective marks in crimes about technically defective vehicles letting into exploitation. Looking at a court practice in Latvia, it seems that the bulk of judgements are about allowing to drive a vehicle to the person not having driving licence or having taken it away. According to the offences related to technically defective vehicles letting into exploitation, these cases have been established very rarely. Looking at regulation of this offence in foreign countries, in the third part of the paper, it seems that the crime included in Criminal Law, article No 263, is not criminalized in a very big part of European countries, Estonia and Lithuania has done the same by not including this rule in their new Criminal Codes. At the end of the diploma paper there are summarized opinions and conclusions of the cognitions achieved during the work with the paper, as well as proposals offered according to the regulations in Criminal Law.
