Bakalaura darba „Autortiesību pārkāpumi autoru darbu izmantošanā” mērķis ir sniegt izpratni par jēdzienu „autortiesību pakāpums”, kā arī raksturot autortiesību pakāpumu veidus un atbildību par autortiesību pakāpumiem, akcentējot uz Latvijas Republikas likumdošanas aktiem.
Izvēlētā temata aktualitāti nosaka apstāklis, ka tehnoloģiskā progresa dēļ rodas vairums jaunu iespēju autortiesību pārkāpšanai. Lai nodrošinātu autortiesību tiesiskā regulējuma atbilstību reāli pastāvošajai situācijai, likumdevējiem ir jāpieņem jaunus un nemitīgi jāgroza spēkā esošus tiesību aktus. Tas, savukārt, rada problēmas tiesību aktu prasību saskaņošanas jomā.
Temata aktualitāti Latvijā, galvenokārt, nosaka problēmjautājumi attiecībā uz starptautisko līgumu un Eiropas Savienības tiesību aktu prasību ieviešanu nacionālā likumdošanā. Autore norāda arī uz pastāvošām problēmām attiecībā uz Latvijas Republikai saistošo tiesību aktu prasību reālo izpildi, norādot, ka tās bieži kalpo par iemeslu autortiesību pārkāpumu izdarīšanai un piedāvā šo problēmu iespējamos risinājumus.
Darba saturu veido trīs nodaļas: pirmajā ir raksturots jēdziens „autortiesību pārkāpums”, otrajā - noteikti un analizēti autortiesību pārkāpumu veidi, bet trešajā tiek raksturota atbildība par autortiesību pārkāpumiem. The aim of the Bachelor’s Paper “Copyright infringement in using works of authors” is to provide understanding of the concept of “copyright infringement” as well as to characterize the types and degrees of copyright liability for copyright infringements, focusing on the legislation of the Republic of Latvia.
The topicality of the theme chosen is proved by the fact that the technological progress causes most of the new opportunities for the copyright violations. In order to ensure the compliance of the copyright legislation with the actually existing situation, the lawmakers have to adopt new legislation and constantly amend the existing one. This, in turn, creates problems of in the field of coordination of the legislative acts.
The topicality of the theme in Latvia is mainly decided by the issues of concern related to implementation of requirements of the international agreements and European Union legislation into the national legislation. The author also points to the existing problems of the actual execution of the legislation binding to the Latvian Republic, underlining that they often serve as a reason for committing copyright infringement, and offers possible solutions to this problem. The Paper consists of three chapters: the first chapter describes the concept of “copyright infringement”, the second — identifies and analyzes the types of copyright infringements, and the third describes in the liability for copyright infringements.
