Abstract

Bakalaura darba temats ir Darba tiesisko attiecību uzteikums saistībā ar darbinieka prettiesisku rīcību un nepietiekamām profesionālām spējām. Darba galvenais mērķis ir izpētīt darba tiesību normu, kas attiecas uz bakalaura darba tēmu, efektivitāti un atbilstību mūsdienu prasībām un praksei, kā arī apzināt praksē pastāvošās un iespējamās darba tiesību problēmas un sniegt to iespējamos risinājumus. Lai iegūtu izpratni par pētāmo tēmu un ar to saistītajiem problēmu jautājumiem un iespējamajiem risinājumiem, bakalaura darba autore ir izpētījusi darba tiesību normatīvo regulējumu, iepazinusies ar Augstākās tiesas Senāta spriedumiem un citu tiesu instanču praksi, kā arī juridisko literatūru, liekot uzsvaru uz problēmām, kas saistītas ar darba devēja darba tiesisko attiecību uzteikumu un Darba tiesībām vispārējā nozīmē. Bakalaura darba tapšanas gaitā, analizējot izvēlētos problēmu jautājumus, bakalaura darba autore ir izdarījusi secinājumus un priekšlikumus, kas varētu būt noderīgi tiesisko regulējumu pilnveidošanai. Bakalaura darba pirmajā daļā autore ir apskatījusi darba devēja uzteikuma, saistībā ar darbinieka prettiesisku rīcību un darba devēja uzticības zaudēšanu, normatīvo aktu regulējumu, normatīvo aktu nepilnības un problemātiku, pievēršot uzmanību gan jēdzienu un formulējumu skaidrojumam, gan uzteikuma pamatojuma nodrošināšanai. Darba otrajā daļā tiek pētīts darba devēja uzteikums, saistībā ar darbinieka nepietiekamām profesionālām spējām, apskatot uzteikuma pamatojuma normatīvo regulējumu un normas piemērošanas iespējas.

The issue of the bachelor’s work is directed to the notice of termination of the employment relationship connected with employee’s lack of professional skills and illegitimate actions. The main goal of the bachelor’s work is to explore the legal side of the employment rights, related to the issue of the bachelors work, its efficiency and compliance to the present day requirements and praxis and study the problems encountered in the practice and offer the possible solutions to those problems. In order to acquire understanding on the selected issue, the author of the bachelor’s work has studied the legal side of the employment rights, acquainted with Supreme courts Senate judgments and other judiciary praxis, as well as other legal literature, focusing attention on problems connected with the notice of termination of the employment relationship and employment rights in general. While creating the bachelor’s work and analyzing the selected problems, the author has carried out conclusions and propositions, which could be useful to improve the legal regulation. In the first part of the bachelor’s work author has examined the legal regulation of employer’s notice of termination because of the employee’s illegitimate actions and disloyalty. Author has also examined legal regulation of normative acts, the deficiency and problems of standard acts, focusing attention on interpretation of notions and definitions and ensurance of the arguments of the notice of termination. In the second part of the bachelors work author has examined the employer’s notice of termination because of the employee’s lack of professional skills, inspecting the legal arguments of the notice of termination and adjusting the correspondent legislation.
