Līgums par profesionālo dienestu un tā tiesiskie aspekti

Abstract

Šajā bakalaura darbā tiek aplūkots līgums par profesionālo militāro dienestu un tā tiesiskie aspekti. Līgums par profesionālo militāro dienestu ir sevišķi aktuāls, kopš Latvijā ir atcelts obligātais militārais dienests un kā vienīgais veids, kā persona var realizēt militāro dienestu ir, slēdzot profesionālā dienesta līgumu. Darbā līgums par profesionālo dienestu pamatā tiek aplūkots no nodarbinātības aspekta, atsevišķus jautājumus aplūkojot arī no cilvēktiesību viedokļa. Darbs sastāv no ievada, četrām nodaļām un kopsavilkuma. Pirmās nodaļas ietvaros tiek aplūkota tiesisko attiecību nodibināšana militārajā dienestā, atklājot to nodibināšanas pamatu un profesionālā dienesta tiesiskos aspektus. Otrā nodaļa analizē līguma par profesionālo dienestu formu un saturu, tā noslēgšanu, izbeigšanas veidus un pagarināšanas kārtību. Darba trešā nodaļa ietver no profesionālā dienesta līguma izrietošo nodarbinātības attiecību salīdzinājumu ar citiem nodarbinātības veidiem Latvijā, atklājot būtiskākās atšķirības starp nodarbinātību profesionālajā militārajā dienestā un citiem nodarbinātības veidiem. Pētījuma pēdējā sadaļā no cilvēktiesību aspekta tiek aplūkoti problemātiski jautājumi saistībā ar atvaļināšanu no militārā dienesta.

In this bachelor work there is described a contract of professional military service and its legal aspects. Contract for professional military service is particularly acute, since the Latvian has lifted the compulsory military service and the only way a person can realize the military services is the closure of a professional service contract. In this bachelor work a contract for professional military service was viewed both from the employment point of view and from a human rights perspective. The work consists of introduction, four chapters and a summary. First chapter deals with the legal relationship in the military service, revealing the basis for the establishment and professional service legal aspects. The second chapter examines the contract for professional services in the form and content of its conclusion, termination types and renewal procedures. The third chapter includes from the professional service contract resulting employment relationship comparison with other employment types in Latvian, revealing the essential differences between the employment of professional military service and other forms of employment. In the last section of the Study from the human rights aspect is dealt with difficult issues related to retirement from military service.
