Konstiutcionālās sūdzības izpratne un tās īstenošanas problemātika Latvijā

Abstract

Šī diplomdarba mērķis ir analizēt un izvirzīt problēmas, kas saistītas ar konstitucionālās sūdzības īstenošanu Latvijā, izvērtējot Satversmes tiesas praksi un konstitucionālās sūdzības teorētisko pamatojumu, un piedāvāt iespējamos variantus izvirzīto problēmu risināšanā. Analizējot konstitucionālās sūdzības būtību un tās īstenošanas problēmas Latvijā, autore nosacīti diplomdarbu iedalīja trīs grupās. Pirmajā nodaļā tiek analizēta konstitucionālās sūdzības būtība, vieta konstitucionālās kontroles teorijā. Autore nošķir konstitucionālo sūdzību no actio popularis. Otrajā nodaļā tiek apskatīta konstitucionālā sūdzība saistībā ar citiem pieteikumu veidiem Satversmes tiesā, kā arī izvirzīti konstitucionālās sūdzības īpašie kritēriji, lai tie atbilstu Satversmes tiesas likuma prasībām. Un trešajā nodaļā autore konstatē konstitucionālās sūdzības problēmas Latvijā un piedāvā to iespējamos risināšanas variantus

The goal of the bachelor paper is to analyze and to draw out problems that were connected with taking to the action the constitutional complaint in Latvia, evaluating constitutional court practice, theoretical substantiation of the constitutional complaint and proposition of the possible variants for solving that problem. Analyzing the essence of the constitutional complaint and its problem for bringing it to an action in Latvia, author of this paper divides bachelor paper into 3 parts. In the first - author analyzes the essence of the constitutional complaint and its place in the theory of constitutional control. In the second - author of this paper considers the constitutional complaint in connection with other types of claims in the constitutional court, and proposes special criteria of the constitutional complaint. In the third -author of this paper verifies the problem of constitutional complaint in Latvia and offers possible variants for solving that problem.
