Saistību bezstrīdus piespiedu izpildīšana

Abstract

Straujas finanšu situācijas pasliktināšanās rezultātā Latvijā ir pieaudzis parādu piedziņas lietu skaits, kas rosināja veikt pētījumu un izstrādāt maģistra darbu „Saistību bezstrīdus piespiedu izpildīšana”. Darba mērķis ir noskaidrot saistību bezstrīdus piespiedu institūta normu saturu, to nepilnības un trūkumus, kā arī to atbilstību saistību bezstrīdus piespiedu izpildīšanas institūta būtībai un mērķim, un starptautisko normatīvo aktu regulējumam. Lai sasniegtu darbā izvirzīto mērķi, tika pielietotas tiesību teorijā sastopamās tiesību normu iztulkošanas metodes, ar kuru palīdzību tika analizēti Latvijas un Eiropas Savienības normatīvie akti, tiesu prakse un vairāku autoru zinātniskās publikācijas. Darbs sastāv no sešām nodaļām. Pirmajā nodaļā tiek apskatīta saistību bezstrīdus piespiedu institūta būtība, mērķis un tā vēsturiskā attīstība. Darba otrās nodaļas piecās apakšnodaļās tiek apskatīti saistību bezstrīdus piespiedu izpildīšanas pieļaujamie veidi un to normatīvais regulējums. Trešajā nodaļā aprakstītas puses lietās par saistību bezstrīdus piespiedu izpildīšanu. Ceturtā nodaļā tiek analizēts pieteikuma saturs, sīkāk apakšnodaļā pievēršoties brīdinājuma tiesiskai analīzei. Darba piektā nodaļā ir apskatīti tiesneša lēmumi, to saturs un veidi lietās par saistību bezstrīdus piespiedu izpildīšanu. Darba sestā nodaļā ir izvērtēta saistību bezstrīdus izpildīšanas apstrīdēšanas kārtība, izvērtējot pārsūdzības neesamības atbilstību Latvijas Republikas Satversmes 92.pantam un apvērsuma prasības būtību. Darba noslēgumā izdarīti secinājumi un izvirzīti priekšlikumi saistību bezstrīdus piespiedu izpildīšanas kārtības un tiesiskās reglamentācijas pilnveidošanai.

Economic recession in Latvia has recently led to a growing numbers of debt claims in Latvian courts which encouraged developing and researching the master thesis “Undisputed Compulsory Execution of Obligations”. The aim of the thesis is to research legislation acts of abovementioned institute and problems thereof, and how they match with goal and essence of the institute. Accordance of the national legislation with international regulations has been researched as well. In order to achieve the aim of the thesis, methods of interpretation of the law has been used which helped to analyze Latvian and EU law, judicial practice and doctrines. Thesis consists of six chapters. The First Chapter comprises description of essence, goal and historical development of the institute of compulsory disputeless performance of obligations. The Second Chapter has five sub-chapters where all kinds of compulsory disputeless performance of obligations have been described, including legal regulations thereof. Parties of cases have been described in the Third Chapter. In the Chapter Four the content of application has been analyzed and in separate sub-chapter described warning legal aspects in details. Decisions of judge and its content and kinds have been analyzed in the Chapter Five. The Chapter Six – analyze of appellation, lack of it and its accordance with the article 92 of Constitution of the Republic of Latvia, reverse claims. In the end of the research there have been made conclusions and suggestions for the improvement of compulsory disputeless performance of obligations procedure and judicial reglamentation.
