Slepkavība, kas izdarīta stipra psihiska uzbudinājuma stāvoklī

Abstract

Bakalaura darbs „Slepkavība stipra psihiska uzbudinājuma stāvoklī” ir radīts, lai izpētītu minētā veida slepkavības sastāvu, noteiktu cēloņus, kas noved pie minētā veida slepkavības izdarīšanas, analīzētu cietušā un vainīgā lomu slepkavības izdarīšanā. Autore darbā atspoguļo svarīgākās problēmas, kas pastāv Latvijas tiesu praksē, kvalificējot slepkavību kā izdarītu stipra psihiska uzbudinājuma stāvoklī, piedāvā problēmu risinājumus. Tāpat darbā tiek atspoguļoti Latvijas un ārvalstu juridiskajā literatūrā izteiktie viedokļi attiecībā uz slepkavību stipra psihiska uzbudinājuma stāvoklī. Tiek analizētas likumdošanas nepilnības, darbā autore piedāvā priekšlikumus likumdošanas pilnveidošanai attiecīgajā jomā. Darbā tika izpētīta slepkavības stipra psihiska uzbudinājuma stāvoklī vēsturiskā attīstība (tika izpētīti tiesību akti attiecīgajā jomā, kas bija spēkā Latvijas Republikas teritorijā XX gadsimtā), juridiskā analīze, kā arī slepkavības stipra psihiska uzbudinājuma stāvoklī vieta ārvalstu (Eiropas valstu) krimināllikumos. Darbā tiek izmantoti un apkopoti Latvijas un ārvalstu juridiskās literatūras avoti, normatīvie akti kā arī tiesu prakses materiāli. Darba nobeigumā seko autores veiktie secinājumi, pastāvošu problēmu analīze un piedāvātie risinājumi, kā arī autores viedokļi par juridiskajā literatūrā izdarītajiem secinājumiem un priekšlikumiem.

Bachelor’s Paper “Murder In A Condition Of Strong Psychic Excitation” is created to study the substance of the mentioned type of murder, to define the causes that lead to the commitment of the mentioned type of murder, to analyze the role of the victim and of the guilty person in the commitment of the murder. Author reflects in the Paper the most important problems that exist in the Court practice of Latvia, qualifying a murder as committed in a condition of strong psychic excitation, offers the solutions of the problems. As well in the Paper there are reflected the opinions expressed in Latvian and foreign legal literature regarding a murder in a condition of strong psychic excitation. There are analyzed the imperfections of the legislation, in the Paper the author offers proposals of the improvement of the legislation in the respective field. In the Paper there has been studied the historical development of a murder in a condition of strong psychic excitation (there have been studied Acts of Law un the respective field that were in force in the territory of the Republic of Latvia in the XX century), legal analysis and its elements (object, unbiased side, subject and subjective side) as well the place of a murder in a condition of strong psychic excitation in the foreign (European countries) Criminal Laws. In the Paper there have been used and summarized sources of Latvian and foreign legal literature, Normative Acts as well the materials of Court practice. In the conclusion of the Paper there follow the conclusions made by the author, the analysis of the existing problems and the offered solutions as well as the author’s opinions about the conclusions and proposals made in the legal literature.
