Bakalaura darba tēma ir starplēmumu kontrole administratīvajā procesā. Darbā tiek apskatīts starplēmumu kontroles institūts gan administratīvajā procesā iestādē, gan tiesā.
Bakalaura darba galvenais mērķis ir pētīt un analizēt starplēmumu kontroles teoriju un praksi Latvijā, pakārtoti salīdzinot to ar ārvalstu un Eiropas Savienības tiesību sistēmu ietvaros pastāvošo šī tiesību institūta izpratni. Tiek izvirzīta tēze, kas nosaka, ka ir nepieciešams paplašināt starplēmumu apstrīdēšanas un/vai pārsūdzības iespējas, tādējādi dodot iespēju indivīdam veiksmīgāk aizstāvēt savas tiesības un tiesiskās intereses attiecībās ar valsti.
Vispirms tiek apskatīts starplēmuma jēdziens un tā nošķiršana no administratīvā akta gan Latvijā, gan ārvalstu un Eiropas Savienības tiesību sistēmās, kam seko starplēmumu kontroles būtība un saturs Latvijā un salīdzinājums ar ārvalstu un Eiropas Kopienas tiesību atziņām šajā jomā. Visbeidzot autore aplūko iespējamos starplēmumu kontroles pilnveidošanas veidus un attīstības perspektīvas.
Darba gaitā tiek secināts, ka starplēmumu kontroli būtu iespējams pilnveidot, paplašinot starplēmumu apstrīdēšanas iespējas un uzliekot iestādei par pienākumu uzklausīt starplēmuma adresāta viedokli pirms tiek izdots personai negatīvas tiesiskās sekas radošs starplēmums. The topic of this bachelor’s thesis is control over pre-decisions in the administrative process. This paper considers both aspects of control over pre-decisions – the control carried out by the administrative courts and the control carried out by state administration.
The main aim of this thesis is to research and analyze the control of pre-decisions in the administrative process, focusing on the situation in Latvia in comparison with the situation in other European states and the European Union. A thesis is established that defines the necessity of broadening control over pre-decisions in order to give individuals the opportunity to protect their rights and legal interests within their relationship with state more successfully.
First of all, the definition of pre-decisions and the separation thereof from administrative acts in the administrative process rights of Latvia is considered in comparison with other European countries and the European Union, secondly, a closer look is taken at the essence and substance of pre-decisions; this is followed by a comparison with foreign and European Community systems. Finally, the author discusses possible ways of improving the control of pre-decisions in the administrative process, as well as some perspectives to develop that process.
The author comes to conclusion that the possible way to improve the control of pre-decisions could be by broadening the right to bring a claim before state authorities. As well the state authority should be obliged to ask the opinion of the individual before it makes a decision that could cause a negative legal effect for this person.
