Valsts prezidenta vēlēšanu mehānisms un tā tiesiskais regulējums Latvijas Republikā

Abstract

Bakalaura darba temats ir „Valsts prezidenta vēlēšanu mehānisms un tā tiesiskais regulējums Latvijas Republikā”. Šajā darbā tiek aplūkota Valsts prezidenta institūta attīstība Latvijas Republikā, īpašu uzmanību pievēršot Valsts prezidenta ievēlēšanas mehānismam un tā iespējamai reformēšanai. Darbā tiek analizēti Latvijas Republikas un Eiropas Savienības valstu tiesību akti. Autores izvēle, analizējot tieši Eiropas Savienības valstu tiesību aktus, ir pamatota ar Latvijas Republikas piederību Eiropas Savienībai un tās tiesību telpai, kā arī kopīgajiem parlamentāras valsts iekārtas tradīcijām. Darba mērķis ir nonākt pie pamatotiem secinājumiem, lai ierosinātu priekšlikumus Valsts prezidenta vēlēšanu mehānisma reformēšanai. Darba mērķa sasniegšanai izvirzīti sekojoši uzdevumi: •izpētīt Valsts prezidenta institūta tapšanu Latvijas Republikā, īpašu uzmanību pievēršot šobrīd esošas Valsts prezidenta ievēlēšanas kārtības veidošanas gaitai; •izpētīt Eiropas Savienības valstu Valsts prezidenta ievēlēšanas kārtības konstitucionālu reglamentāciju; •izpētīt Valsts prezidenta ievēlēšanas kārtības un ar to saistīto aspektu esošo tiesisko regulējumu Latvijas Republikā; •apskatīt kāda argumentācija ir lietota tautas vēlēta Valsts prezidenta institūta, kā pamatidejas šī institūta reformēšanai, piekritēju un pretinieku vidū un veikt pausto argumentu analīzi; •piedāvāt ierosinājums Valsts prezidenta institūta reformēšanai. Bakalaura darbam ir gan teorētiska, gan praktiska nozīme, to varētu izmantot gan studenti mācību procesā, gan arī citi interesenti, lai labāk izprastu Valsts prezidenta institūta būtību Latvijas Republikā un tā iespējamas reformēšanas risinājumus.

The topic of the Bachelor thesis is „The mechanism of the elections of the President and it’s legal regulation in the Republic of Latvia.” In the thesis legislation of the Republic of Latvia and the member states of the European Union is analysed. Author’s choice of the analyse of legislation of the European Union member states is based on the belonging of the Republic of Latvia to the European Union, it’s legal system as well as common parliamentary state order traditions. The purpose of the Diploma thesis is to come to a reasonable conclusion, in order to offer suggestions about reformation of the President elections mechanism. In order to reach the purpose the following tasks were brought forward: •To research the establishment of the institution of the President of State, giving particular attention to the process of formation of the President elections procedure; •To research the constitutional regulation of the President elections in European Union member states; •To research existing legal regulation of the procedure of the President elections and relating aspects in the Republic of Latvia; •To review the arguments of the formation of President institution between it’s supporters and contestants and to make an analyse of the arguments; •To offer suggestions about the reformation of the President of State institution. This paper has both theoretical and practical significance. It can be used by students during the studies and other people to understand the meaning of the President of State institution and possible reformation resolution.
