Tiesneša ētikas problēmjautājumi

Abstract

Jautājumi, kas saistīti ar tiesneša ētiku, Latvijas tiesību zinātniskajā literatūrā ir maz pētīti. Pastāv dažādi gadījumi praksē, kad .tiek spriests par tiesneša objektivitāti, neatkarību, politisko un ārpustiesas dzīvi. Galvenie Bakalaura darba mērķi: •Apkopot praksi un precedentus; •Salīdzināt regulējumu un izpratni Latvijā un ārvalstīs; •Izvērtēt tiesas spriešanas un tiesneša ētikas likumsakarības; Autore nonāca pie jaunām atziņām, izvirzīja darbā vēl nepētītus jautājumus. Rezultātā ir apzinātas problēmas un to iespējamie risinājumi Latvijā, prakse ārvalstīs. Tāpat izvērtēts, cik ļoti un kādos gadījumos tiesneša ētikas ievērošana atstāj iespaidu uz tiesas spriešanu.

Te issues related to judicial ethics have not been studied in latvian legal literature. There are different situations in practice when the judge's impartiality, independence, political and court life has been widely discussed. The main objectives of the Bacelors work are: •The maintenance of practices and precedents; •The comparison between the framework and understanding of judicial ethics in Latvia and foreign countries; •The evaluation of the regularities of justice and judicial ethics.

The author came to new ideas, put forward the work of unstudied issues. However, in the result, identifiying the problems and possible solutions in latvian law. Also examining how and under what circumstances a judges ethical issues are affecting the administration of justice.
