Piespiedu nomas tiesiskās attiecības

Abstract

Bakalaura darbā aplūkota tēma par tiesiskajām problēmām, kas rodas situācijās, kad atšķiras zemes un uz tās atrodošās apbūves īpašnieki. Darbā apskatīti piespiedu nomas veidošanās vēsturiskie apstākļi un analizēti strīdu, kas izceļas zemes un apbūves īpašnieku starpā, rašanās iemesli. Bakalaura darba ietvaros veikts tiesību normu, kas attiecas uz piespiedu nomu, nepilnīgā regulējuma atspoguļojums. Darbā izvērtētas piespiedu nomas attiecības no saistību un lietu tiesību viedokļa, kā arī analizēts jautājums par pašreizējā piespiedu nomas regulējuma atbilstību Latvijas tiesību sistēmai. Pētījuma izstrādes rezultātā, bakalaura darba autore izvirzījusi aizstāvēšanai vairākus priekšlikumus, lai nodrošinātu starptautiski saprotamu regulējumu dalītā īpašuma gadījumiem.

Bachelor's work considers the theme of the legal problems that arise in situations where differs the owners of land and buildings located on the same land. The work represents the historical conditions of forced lease formation and analyzes the causes of disputes, which arise among the owners of land and buildings. Bachelor's work reflects the incomplete regulation of the rules governing the forced lease. The work reviews the forced lease relationship from the point of wiew of the contract law and the case law, as well as analyses the compliance of current regulation of the forced lease with the Latvian national legal system. The author of the bachelor’s work propounds several suggestions to provide an internationally understandable framework for shared ownership cases.
