Bakalaura darbā „Kriminālatbildība par piesaistību noziedzīgam nodarījumam” tiek apskatīta piesaistības institūta vēsturiskā attīstība Latvijas Republikā, tā regulējums un būtība Latvijas krimināltiesībās, atšķirība un līdzība līdzdalības institūtam, kā arī piesaistības jēdziena salīdzinājums ar ārvalstu krimināllikumiem. Bakalaura darba tēmas aktualitāte ir saistīta ar tiesu praksē sastopamiem gadījumiem, kuros tiesa nepareizi izprot jēdzienu „piesaistība”, kļūdaini uzskatot šo tiesību institūtu par līdzdalību. Nepieciešamība nošķir šos divus tiesību institūtus izriet no apstākļa, ka tiem ir dažāda kaitīguma smaguma pakāpe un atšķirīgs juridiskais novērtējums. Darbā tiek pētīti tādi piesaistības veidi kā iepriekš neapsolīta slēpšana, neziņošana par noziegumu un noziedzīga nodarījuma pieļaušana, kā arī minēti citi piesaistības veidi, par kuriem kriminālatbildība ir paredzēta Krimināllikuma Sevišķajā daļā. Darbā ir aplūkota Latvijas tiesu prakse attiecībā uz piesaistības institūtu un krimināltiesību literatūra, kā arī sniegts autores viedoklis par iespējām, kā varētu pilnveidot piesaistības institūta regulējumu Krimināllikumā.

The present Bachelor Paper “Criminal Liability of the Attachment to Crime” investigates the historical development of the Attachment Institute in the Republic of Latvia, its regulation and essence in criminal rights of Latvia, difference and similarity to the attachment institute, as well as the comparison of the attachment term to the foreign criminal laws. The importance of the Bachelor Paper is connected with the cases encountered in the court practice, where the court misinterprets the term “attachment”, considering the institution of rights mistakenly as complicity. The necessity to separate these two institutions of rights derives from the fact that they have got different levels of harm and they have got different judicial assessment. The present paper examines attachments such as concealment without prior promise, not reporting about a crime, and admission of a criminal offence, as well as other types of attachments that carry criminal liability, which is determined in Criminal Law Particular Part. In the paper the practice of Latvia courts has been studied in relation to the literature of attachment institutions and criminal rights, the point of view of the author about the possibilities to improve the regulation of attachment institution in Criminal Law is also presented.
