Kriminālatbildība par dienesta pilnvaru pārsniegšanu valsts amatpersonu darbībā

Abstract

Bakalaura darba tēma ir „Kriminālatbildība par dienesta pilnvaru pārsniegšanu valsts amatpersonu darbībā”, kurā autore analizē noziedzīgu nodarījumu, kas ietverts Krimināllikuma 317.pantā. Darba autore, analizējot normas vēsturisko attīstību, tiesību zinātnieku darbus un pēdējo gadu Latvijas tiesu praksi, veic normas satura analīzi, analizējot priekšnosacījumus personas saukšanai pie kriminālatbildības saskaņā ar šo pantu, aplūko normas objektīvās un subjektīvās pazīmes, panta saistību ar citām Krimināllikuma normām un piemērojamos sodus. Tādējādi tiek konstatēta esošā situācija un ieskicētas problēmas. Darba kopsavilkumā autore tēžu veidā pauž darba gaitā gūtos secinājumus un ierosinājumus, kā arī piedāvā iespējamo KL 317.panta redakciju.

The theme of the bachelor paper is “Criminal sanctions for exceeding official authority of public officials”, in which the author analyzes the offense contained in article 317 of the Criminal Law. The author, analyzing the historical development of article, the scientific work and Latvian court practice in recent years, analyzes the content of article, the preconditions for personal criminal prosecution under this article, looks at objective and subjective symptoms, connection with other article of Criminal Law and applicable penalties. Thereby, the author notes the current situation and outlines the problems. In summary in the form of thesis the author expresses the results and recommendations, as well as offering a possible version of the article 317.
