Maģistra darba tēma ir „Aizturēšana kā kriminālprocesuālais piespiedu līdzeklis pirmstiesas kriminālprocesā”. Darba izpētes objekts ir kriminālprocesuālā aizturēšana, tās teorētiskais un normatīvais regulējums, kā arī praktiskā piemērošana.
Aizturēšana ir viens no smagākajiem kriminālprocesuālajiem institūtiem, jo tā saistīta ar personas brīvības ierobežošanu kam pretstatītas tiek visas sabiedrības tiesību aizsardzības un drošības garantēšanas intereses. Darba ietveros konstatēts, ka ar aizturēšanu saistīta gan teorētiska viedokļu sadursme šī kriminālprocesuālā institūta definēšanā un būtības identificēšanā, gan normatīvā regulējuma nepilnības, gan problēmas, ar kurām nākas saskarties procesa virzītājam piemērojot aizturēšanu kā procesuālo iespiedu līdzekli praksē.
Ņemot vērā, ka Kriminālprocesa likums nesniedz pilnīgu regulējumu attiecībā uz aizturēšanas pamatu un nosacījumiem, kā viens no darba mērķiem tika izvirzīts izzināt un aprakstīt tieši aizturēšanas piemērošanas pamatu un nosacījumus, kā garantu patvaļīgas aizturēšanas nepieļaušanai, no prakses un normatīvā regulējuma konstatēt aizturēšanas mērķi un aprakstīt aizturēšanas veikšanu starptautiskā mērogā saistībā ar Latvijas dalību Šengenas konvencijas zonā, tādējādi, atsevišķā darba nodaļā aprakstīta dokumentu noformēšana, kompetento iestāžu pilnvaru apjoms un praktiskā aizturēšanas realizēšana.
Darbs sastāv no četrām nodaļām, kuru ietvaros tika veikts aizturēšanas kriminālprocesuāli normatīvā regulējuma un teorijas izklāsts un analīze, prakses apskats, aprakstot ar aizturēšanas piemērošanu saistītās problēmas praksē, kā arī darbā tiks apskatīts aizturēšanas jautājums Šengenas konvencijas zonā. This master thesis is entitled „Arrest as a criminal procedural compulsory measure in pre-trial criminal proceedings”. The subject of the thesis is criminal procedural arrest, its theoretical and regulatory basis, as well as practical application.
Arrest is one of the most serious criminal procedural tools, because it is related to limitation of liberty of a person contrary to interests of protection of rights and ensuring the security of the whole society. The thesis reveals that in relation to arrest there are different contradictory theoretical points of views regarding its definition and determining of its meaning, there are shortfalls in the regulation, as well as problems faced by persons directing the proceedings (investigators, prosecutors) applying arrest as compulsory procedural measure in practice.
Taking into account that the Criminal Procedure Law does not regulate in a comprehensive manner the basis and conditions of the arrest, one of the aims of the thesis is to describe and study specifically what forms the basis of an arrest and what the conditions of it are in order to ensure that arbitrary arrests are avoided, also to study the regulation and practice and determine what the objective of an arrest is and to describe the international dimension of the arrest in the context of Latvia’s participation in the Schengen zone. A separate section of the thesis is dedicated to the issue of drafting relevant documents, duties of competent authorities and implementation of the arrest.
This thesis is divided in four parts containing a review and analysis of criminal procedural regulatory and theoretical basis of the arrest, review of practical application and existing problems and a review of the implementation of arrest in the Schengen zone.
