Arodbiedrības biedra tiesiskā aizstāvība darba attiecībās

Abstract

Darba devēja un arodbiedrības attiecības un to tiesiskais regulējums vienmēr bijis aktuāls problēmjautājums strādājošo vidū, to atspoguļo tiesu prakse saistībā ar šīm attiecībām. Latvijā tiesikais regulējums par darba līguma uzteikšanu arodbiedrības biedram rada neizpratni tā piemērošanā, izšķirot strīdus starp darba devēju un arodbiedrībām par darbinieka tiesībām. Līdz ar to šāda nekonsekvence var nelabvēlīgi ietekmēt gan darbinieka, gan darba devēja intereses. Autors darbā atklājis tiesiskā regulējuma nekonsekvenci un piedāvā risinājumus šo tiesību normu piemērošanā, lai tas nekaitētu darbinieku un darba devēju interesēm. Darba mērķis ir pievērt uzmanību nepilnībām regulējumā, jo palielinoties arodbiedrības lomai darba tiesiskajās attiecībās, veidojas arī plašāka prakse attiecībā uz tām, kas atklāj šīs nepilnības, tās novēršot varētu atslogot tiesas no nevajadzīgiem procesiem.Employer and trade union relations and its legislative regulations have always been a topical concern of the working population, which reflects in the jurisprudence of this relationship. Latvian legislative framework of the contract cancellation of a trade union member creates confusion in its application, in the resolution of disputes between employers and trade union employee rights. Consequently, such inconsistency can adversely affect both the employee and the employer's interests. The author discovered the work of legislative regulatory inconsistent and proposes solutions to the use of the legal regulations, so they wouldn’t harm the interests of employees and employers. The objective is to turn attention to weak points in the regulatory framework, because the increasing role of trade unions in employment relations also widens the formation of practice who reveal the gaps, eliminating them the court wouldn’t be overloaded with unnecessary processes.
