Darba tēma ir civilprocesuālās rīcībspējas institūts.
Galvenā uzmanība tiek veltīta civilprocesuālās rīcībspējas reformai saistībā ar rīcībspējas institūta paradigmas maiņu, ko nosaka Apvienoto Nāciju Organizācijas Konvencija par personu ar invaliditāti tiesībām. Darba mērķis ir noteikt civilprocesuālās rīcībspējas institūta teorētiskos ietvarus, vērtējot no cilvēktiesību padziļinātā skatījuma, kas aizliedz jebkādas izpausmes, kurās personas griba un preferences tiek aizvietotas. Lai sasniegtu darba mērķi, tiek definēti civilprocesuālās rīcībspējas institūta obligātie elementi atbilstoši jaunajām prasībām, analizēti Civilprocesa likuma terminoloģijas maiņa, izstrādāti civilprocesuālās rīcībspējas ierobežošanas kritēriji, personām ar dažādiem rīcībspējas statusiem noskaidrota civilprocesuālā nozīme tiesvedībā.
Tiek secināts, ka civilprocesuālas rīcībspējas institūta procesuālais regulējums ir atbilstošs starptautiskajām tiesību normām un šī brīža aktuālai tiesību teorijai, bet no likuma piemērotāja ir atkarīgs kā civilprocesā tiks iztulkoti tādi atvērtie jēdzieni kā personas griba un preferences, personas ar ierobežotu civilprocesuālo rīcībspēju līdzdalība tiesvedībā. Tādējādi funkcionālā pieeja tiek izvirzīta kā civilprocesuālās rīcībspējas vērtēšanas metode pretēji statusa un racionalitātes metodei, lai izvērtētu kāds atbalsts civilprocesā ir nepieciešams personai ar invaliditāti, lai nodrošinātu efektīvu tiesas pieejamību personām ar invaliditāti vienlīdzīgi ar citiem.
Darbā tiek sniegti pretargumenti Latvijas Republikas Tiesībsarga viedoklim, kurš uzskata, ka personai nav ierobežojamas tiesības vērsties tiesās, kā arī saglabājama civilprocesuālā rīcībspēja jomās, kurās ir noteikta ierobežota rīcībspēja. Uz pretargumentu pamata ir izvirzīti civilprocesuālās rīcībspējas ierobežošanas kritēriji.
Ierosinājumi attiecas galvenokārt uz tām likuma normām, kurās pēc autores domām būtu jāpaplašina personas tiesības ierobežotajā apjomā.

The main focus of the work is devoted to the legal capacity of civil procedure reform in relation to the paradigm shift of the institution of legal capacity, which is laid down in the Convention on the Rights of Persons with Disabilities.
The objective of this work is to set the legal boundaries of the legal capacity of civil procedure by evaluating the human rights from the perspective what prohibits, that any expression of personal will and preferences are replaced.
To achieve the work’s goal, the required elements of the legal capacity of civil procedure are defined in accordance with new requirements. The change of the terms of the Civil procedure law is also analysed, the restriction criteria of the legal capacity are elaborated and established the role in the civil proceedings regarding the persons with the different statuses of the legal capacity.
The author comes to the conclusion that the procedural framework of the legal capacity of civil procedure institute is in accordance with the international law and the currently legal theory, still the one who applies the laws will determine the interpretation of the open concepts in the Civil procedure, like persons will and preferences, and participation in the proceedings of the persons with limited capacity of the civil procedure.
Accordingly, the preference is given to the functional approach as the evaluating method of the legal capacity of civil procedure, contrary to the status or rationality approach, in order to evaluate the needed level of support to the person with a disability, in order to ensure equal access to justice for every person without exception.
It is being presented counterarguments regarding the position of the Ombudsman, that a person shall not have limited right of access the courts, as well person’s legal capacity of civil procedure is preserved in areas where there is restricted capacity. The restriction criterions of the legal capacity of the civil procedure are proposed regarding above mentioned counterarguments.
