Tiesu kriminālistiskās ekspertīzes kriminālprocesā

Abstract

Maģistra darbs ir par tiesu kriminālistiskās ekspertīzes nozīmi kriminālprocesā, tiesu kriminālistisko ekspertīžu veidiem, noteikšanas problemātiku, kā arī tiesu eksperta kā „zinātniskā tiesneša” lomu kriminālprocesā. Darbā apskatīta papildu un atkārtotas ekspertīzes nošķiršanas problemātika praksē, komisijas un kompleksās ekspertīzes noteikšanas īpatnības un nepieciešamība, kā arī dažādu specialitāšu tiesu kriminālistisko ekspertīžu savstarpējās saskaņošanas iespējas. Apzināts tiesu eksperta darbības šī brīža tiesiskais regulējums Latvijā, izanalizētas Tiesu ekspertu likuma normas, to ieviešanas process praksē, saskaņošana ar citiem normatīvajiem aktiem, kā rezultātā autore sniedz priekšlikumus vairākiem Tiesu ekspertu likuma grozījumiem. Darbā veikts salīdzinājums tiesu kriminālistiskās ekspertīzes procesuālajam regulējumam Latvijā, Krievijā un Eiropas valstīs, identificētas Eiropas tiesu ekspertīžu iestāžu asociācijas pamatprasības veiksmīgai sadarbībai un kopīgā mērķa sasniegšanai – neatkarīgai, tiesiskai un objektīvai tiesu ekspertīzei.

This paper „Forensic investigations in the Criminal Procedure Law” examines importance of the forensic investigation in Criminal Procedure, importance of the forensic scientist in criminal procedure like “scientific judge”, classification of the forensic investigations types and also problems that arises during forensic investigation appointment. This includes problems of possibility to distinguish following types of forensic investigation: /collateral forensic investigation and repeated/ /forensic investigation/, also individuality and necessity of /commission and complex forensic investigation/, as well as mutual coordination of several different fields of investigation with other laws and regulations. Summarized current legal regulations of the forensic expert activity, analyzed “Law of forensic scientist” legal regulations and implementation of this law in practice and integration with other laws and regulations. This results that author suggests several amendments of this discussed law. In this paper is performed comparison of legal procedure for forensic investigation in Latvia, Europe Union and Russia. It establishes the basic requirements for successful collaboration of European forensic institutions to set a common target which includes independent, legal and objective forensic investigation.
