Darba ietvaros autors analizēja Krimināllikuma 175. pantā paredzētā noziedzīgā nodarījuma – zādzības sastāvu. Pētījuma priekšmets – krimināltiesību normas, kas regulē ar mantas nolaupīšanu (t.sk. arī zādzību) saistītos jautājumus, teorētiskie viedokļi, tiesu prakse.
Uz krimināltiesiskās attiecības regulējošo normu, zinātniskās literatūras un tiesību piemērošanas prakses analīzes bāzes izpētīta par mantas nolaupīšanu paredzēto atbildība un priekšnosacījumi personas saukšanai pie atbildības. Mērķa sasniegšanai, autors izvirzīja šādus uzdevumus: Krimināllikuma 175. pantā paredzētā noziedzīgā nodarījuma sastāva analīze; zādzības objektīvo un subjektīvo pazīmju izpēte; pantā paredzēto noziedzīgu nodarījumu kvalificēto sastāvu izpēte; pantā noteikto noziedzīgu nodarījumu sastāvu nošķiršana no līdzīgiem.
Darba ietvaros izdarīti secinājumi, kā arī norādīts uz diskutabliem problēmjautājumiem. Within the framework of the Paper Theft And It’s Distinction From Other Type Of (Movable) Properties the Author analyses the elements of the criminal offence – the theft, according to the Section 175 of the Criminal Law. The subject of the research – the rules of the Criminal law applicable to the issues of the robbery of property (including theft), theoretical opinions and the case law.
The liability and the grounds for prosecution of an individual are examined in terms of laws and regulations governing the criminal law relations and on the basis of scientific literature and practice regarding the application of legal rules. For the purpose of achieving the set goal the Author proposes the following tasks: analysis of the elements of the criminal offence according to Section 175 of the Criminal Law, the study of the objective and subjective characteristics of theft, research of the qualification of criminal offences in compliance with the provisions of the Section and distinction of the criminal offences from similar elements.
Conclusions are drawn and controversial problem issues are pointed out in the framework of this research.
