"Darbinieka atbildība darba tiesībās"

Abstract

Autore izvēlējās darba tematu “Darbinieka atbildība darba tiesībās”, jo šī tēma ir nozīmīga darba tiesību sastāvdaļa. Darba mērķis ir noskaidrot darbinieka civiltiesiskās un disciplinārās atbildības iestāšanās priekšnoteikumus un piemērošanas aspektus, kā arī strīdu, saistītu ar darbinieka atbildību, risināšanas kārtību. Darba mērķi autore sasniedz, pētot un salīdzinot Latvijas un ārzemju normatīvo regulējumu, pētot Latvijas tiesu praksi un Latvijas un ārzemju juridisko literatūru. Darba izstrādes procesā, analizējot Latvijas un ārzemju darbinieka atbildības institūta regulējumu, autore nonāca pie secinājuma, ka Latvijas regulējumam vairākos aspektos nepieciešama konkretizācija un pilnveidošana. Darbs sastāv no trim daļām. Pirmajā daļā ir aplūkoti darbinieka civiltiesiskās atbildības aspekti, otrajā daļā ir aplūkoti darbinieka disciplinārās atbildības aspekti un trešajā daļā ir aplūkota strīdu risināšanas kārtība.

The author choses the topic of bachelor thesis "The employee's responsibilty in the labour law", because this topic is an important part of the labour law. The aim of the work is to find out conditions of approach of an employee's civil and disciplinary responsibility and aspects of it application, and also an order of the solution of disputes connected with responsibility of the employee. The aim of the work author reaches researching and comparing Latvian and foreign normartive regulation, researching case law, Latvian and foreign legal literature. In researching process analyzing the regulation of Latvian and foreign employee's responsibility, the author came to the conclusion that the Latvian regulation of several aspects need improvement and concretization. The work consists of three parts.
