Abstract

Naida kurināšana autora ieskatā ir aktuāla mūsdienu problēma, jo tas ir noziedzīgs nodarījums, kuram par motīvu kalpo tādas cilvēka iezīmes, kuras cietušai personai ir kopš dzimšanas un kuras tā nevar mainīt, tādēļ personas intereses tiek aizskartas tikai tās izcelsmes dēļ, kas norāda uz šī noziedzīgā nodarījuma apdraudējumu sabiedrības saliedētībai. Autors savā darbā ir iepazinies ar Latvijas teoriju un praksi šajā jautājumā, veicis ECT judikatūras izpēti, kā arī iepazinies ar naida kurināšanas regulējumu ārvalstu krimināllikumos, lai noskaidrotu, kādos gadījumos izteikumi ir uzskatāmi par naida kurināšanu, kā arī, lai izprastu, kādi ir šā brīža Krimināllikuma 78. panta trūkumi un kā pēc autora domām tos varētu novērst.

Hate speech in authors opinion is an actual problem of nowadays, because it’s a crime, which motive is persons special features, that the victim persons have since their birth and which they aren’t able to change, that’s why, person interests are offended only because of their origin, not because of any other reason, which indicates this crime as a threat to the unity of the society. Author in his thesis analyzed the theory and practice of this topic, researched the jurisdiction of European Court of Human Rights, as well as analysed the criminal laws of the foreign countries, to understand the current disadvantages of Criminal Codes article 78 and how in authors opinion they should be avert.
