Īpatnības kriminālprocesos ar nepilngadīgo izdarītiem noziedzīgiem nodarījumiem

Abstract

Maģistra darbā “Īpatnības kriminālprocesos par nepilngadīgo izdarītiem noziedzīgiem nodarījumiem” tiek pētītas Latvijas Republikas un citu valstu kriminālo un kriminālprocesuālo normatīvo aktu, kas attiecināmi uz šo kategoriju, īpatnības, svarīgākie starptautiskie normatīvie akti un pētījumi, kas saistīti gan ar nepilngadīgo likumpārkāpēju tiesību procesuālo aizstāvību, gan ar nepilngadīgo psihes aizsardzību no tādas iedarbības, kuru uz tiem var atstāt izmeklēšana un tiesa, kā arī pats soda piemērošanas fakts. Darbs sastāv no ievada, galvenās daļas, izmantoto normatīvo aktu un literatūras saraksta un pielikumiem. Ievadā autore uzsver izmantotās pētnieciskās tēmas aktualitāti un sniedz vispārējas ziņas par nepilngadīgo noziedzības līmeni Latvijā un citās valstīs. Galvenajā maģistra darba daļā jēdziens “nepilngadīgais” kriminālprocesā tiek salīdzināts ar citās tiesību nozarēs dotajām definīcijām, tiek sniegts nepilngadīgo kriminoloģisko psiholoģisko īpatnību apraksts, tiek pētīti obligātās kriminālprocesuālās aizstāvības un nepilngadīgo personu pārstāvniecības institūti, atsevišķu izmeklēšanas darbību veikšanas īpatnības un procesuālo piespiedu līdzekļu piemērošanas nosacījumi, izmeklējot dotās kategorijas lietas. Pēdējā nodaļa veltīta kriminālprocesu pret nepilngadīgajām personām izbeigšanas īpatnībām, tai skaitā nepilngadīgā apsūdzētā atbrīvošanai no soda, pielietojot audzinoša rakstura piespiedu līdzekļus. Nobeigumā formulētas pētījuma rezultātā noskaidrotās Latvijā spēkā esošās kriminālprocesuālās likumdošanas pozitīvās puses, kā arī nepilnības un izteikti priekšlikumi tās pilnveidošanai.

The present Master’s Paper “Peculiarities in Criminal Procedures on Juvenile Delinquency” deals with the research of peculiarities of the criminal and criminal procedural laws and regulations of the Republic of Latvia and other states, referable to this category, essential international laws and regulations and studies, related to both the procedural defence of juvenile offenders’ rights and the protection of juvenile psyche from the possible impact of investigation and trial, as well as from the very fact of penalty infliction. The paper consists of introduction, main part, bibliography of the source laws and regulations and literature, and appendices. In the introduction the author emphasizes the topicality of the present research issue and provides with general information about the juvenile crime rate in Latvia and other states. In the main part of the Master’s Paper the concept “juvenile” in criminal procedure is compared with definitions, used in other legal disciplines; the psychological peculiarities of juvenile delinquency are described; the research on the compulsory criminal procedural defence and juvenile representation institutes, peculiarities of particular investigation performance and conditions of the application of procedural coercive methods during the investigation of the cases in the given category is carried out. The final chapter deals with the peculiarities of dismissal of criminal procedure against the juvenile, including let-off of a juvenile defendant, by applying coercive methods of instructional nature. As a result of the research, the conclusion defines the advantages, as well as deficiencies of the effective criminal procedural legislation of Latvia, and proposals are made for its improvement.
