Saeimas ievēlēšanas tiesiskie aspekti un problemātika.

Abstract

Maģistra darba mērķis ir, identificējot Saeimas ievēlēšanas problemātiku un izvērtējot vēlēšanu sistēmas tiesiskos aspektus, izvirzīt priekšlikumus Latvijas vēlēšanu sistēmas pilnveidošanai. Tā kā demokrātija iegūst konkrētu veidolu cilvēku apziņā tieši vēlēšanu formā, būtiski ir pilnveidot un novērst trūkumus pārstāvniecības realizācijas mehānismam, jo tās efektivitāte ir atkarīga no vēlēšanu sistēmas normatīvā regulējuma. Autore, darbā atklājot un izvērtējot vēlēšanu sistēmas problemātiku, secina, ka sabiedrības un politisko partiju izpratnes trūkums par vēlēšanu tiesisko specifiku, procesuālās nepilnības organizējot vēlēšanas un proporcionalitātes principa nepilnīga ievērošana ir sekas vājajai saiknei starp parlamenta deputātiem un vēlētājiem. Rezultātā tiek izvirzīts priekšlikums noteikt mazāku procentu barjeru.

The aim of the Master paper is to propose suggestions for the election system in Latvia in order to make an improvement. This goal is achieved by identifying the problems of election process of Saeima and evaluating the legal aspects of the election system. It is essential to improve and prevent the lacks in the mechanism of the realisation of representative power as democracy obtains its partical pattern in peoples’ consciousness by the form of the elections. The author concludes that consequences of the insufficient link between deputies and their voters are because the society and political parties lack comprehension of the legal specification of elections. Certainly, the other reasons are incompletenesses in the procedure of the elections and partial observance of proportional principal. Conclusions are drawn out by revealing and evaluating the problems of election system in Latvia. As a result the author suggests decreasing the percentage barrier.
