Spēkā esošais likuma „Par nekustamā īpašuma nodokli” tiesiskais regulējums praksē rada dažādus problemātiskus aspektus attiecībā uz nekustamā īpašuma nodokļa maksāšanu un apstrīdēšanu.
Maģistra darba mērķis ir, analizējot teorētisko bāzi par maksāšanas paziņojuma par nekustamā īpašuma nodokli statusu nodokļu tiesībās, saistībā ar vispārējiem tiesību principiem un tiesu praksi, kā arī praktisko informāciju par materiālo tiesību normu un procesuālo tiesību normu piemērošanu nekustamā īpašuma nodokļa lietās Latvijā saistībā ar nekustamā īpašuma nodokļa apmēra noteikšanu, tā rezultātā atklāt būtiskākos nekustamā īpašuma nodokļa maksāšanas un apstrīdēšanas tiesiskā regulējuma problemātiskos aspektus Latvijā un izstrādāt priekšlikumus par atklāto problemātisko aspektu risinājumiem.
Autore ir izstrādājusi konkrētus normatīvo aktu grozījumu priekšlikumus, ar kuriem tiktu novērstas līdzšinējā normatīvā regulējuma nepilnības. In practice the effective legal regulation of the Law on Immovable Property Tax imposes different complicated aspects regarding settlement and disputing the Immovable Property Tax.
The objective of the Master’s Thesis is to establish the most significant problem areas of the legal regulation for settlement and disputing the Immovable Property Tax in Latvia by analyzing the theoretical basis for the status of the Property Tax Notice in tax law, with relation to the general legal principles and jurisprudence, as well as to the practical information about the application of material legal standards and procedural legal standards to the cases of Immovable Property Tax in Latvia with respect to determining the extent of Immovable Property Tax, and to elaborate recommendations of solutions for the established problem areas.
The Author has elaborated specific recommendations for amendments of the regulatory legal acts, which would eliminate the incompleteness of the current regulatory provisions.
