Darba „Ar brīvības ierobežošanu saistītu sodu piemērošana nepilngadīgajiem” ietvaros autore veic analīzi par ar brīvības ierobežošanu saistītu sodu atbilstību nepilngadīgajiem, apskata alternatīvas un izvērtē to atbilstību arī pētot tiesu praksi. Lai gūtu pilnīgu izpratni par minēto sodu atbilstību nepilngadīgajiem, autore apmeklē audzināšanas iestādi nepilngadīgajiem, kur nepilngadīgie izcieš brīvības atņemšanas sodu.
Darba mērķis ir izvērtēt situāciju Latvijā un sniegt priekšlikumus, lai ar brīvības ierobežošanu saistītu sodu piemērošana un izpilde nepilngadīgajiem būtu pēc iespējas efektīva un atbilstoša lietas faktiskajiem apstākļiem.
Darbs sastāv no četrām nodaļām, no kurām pirmajā ir veikts vēsturiskais apskats par ar brīvības ierobežošanu saistītu sodu piemērošanu nepilngadīgajiem Latvijas teritorijā sākot no 1904.gada līdz Krimināllikuma spēkā stāšanās brīdim, bet turpinājumā tiek analizēts nepilngadīgais kā tiesību subjekts. Otrajā nodaļā autore analizē brīvības atņemšanas soda piemērotību nepilngadīgajiem saskaņā ar Krimināllikumu un analīzei izmanto arī statistikas datus un apskata tiesu praksi. Trešajā nodaļā autore apskata, kādas ir alternatīvas tiesai nosakot sodu nepilngadīgajam, lai izvairītos no tāda veida soda, kas ierobežo brīvību. Savukārt, ceturtajā nodaļā tiek apskatīta brīvības atņemšanas izpilde Iļģuciema cietuma audzināšanas iestādē nepilngadīgajiem un Cēsu audzināšanas iestādē nepilngadīgajiem. Piektajā nodaļā ir veikts tuvāku un tālāku ārvalstu krimināltiesisko regulējumu salīdzinājums attiecībā uz nepilngadīgajiem piemērojamiem ar brīvības ierobežošanu saistītiem sodiem un veikts salīdzinājums ar Latvijā pastāvošo regulējumu.
Darbā mērķa sasniegšanai tiek izvirzīti septiņpadsmit secinājumi un priekšlikumi. Darbs sastāv no piecām nodaļām, kopā astoņdesmit trīs lapām. Darbā tiek izmantota Latvijas un ārvalstu literatūra un normatīvie akti, kā arī Latvijas tiesu prakse, kopā izmantoto avotu skaits ir astoņdesmit septiņi. In the framework of the master thesis “Implementation of punishments for juvenile that limit the freedom” the author has conducted an empirical analysis on conformity of limitation of freedom for juvenile and has examined and evaluated alternatives in existing jurisprudence. In order to get an understanding about the conformity of the abovementioned punishments, the author has visited an institution for juvenile imprisonment.
The main goal of this master thesis is to examine juvenile imprisonment situation in Latvia and to offer recommendations and solutions for enhanced effectiveness and conformity of punishment implementation.
The study consists of four parts. In the first chapter the author has developed chronologic outlook on punishments for juvenile that limit the freedom in the territory of Latvia from year 1904 until the introduction of Criminal Law. Later in the thesis the subject of analysis is juvenile itself. In the second chapter the author has examined conformity of imprisonment for juvenile in accordance with Criminal Law. Statistical data and jurisprudence have been used in the analysis. In the third chapter the author has described alternatives of imprisonment for juveniles, avoiding punishments that limit the freedom. In the forth chapter author describes imprisonment in Ilguciema prison correctional institution for women juveniles and in Cesu correctional institution for juveniles. Lastly, in the fifth chapter author has examined criminal regulations in different foreign countries, regarding punishments that limit the freedom. Later comparison has been made between Latvia’s and other foreign countries’ practices in this matter.
In order to achieve the goal of the thesis, the author has come out with seventeen conclusions and recommendations. The study consists of five chapters and eighty three pages. Latvian and foreign literature, as well as laws and regulations have been used in the study. The overall amount of them is eighty seven.
