Laulāto līgumisko mantisko attiecību problēmjautājumi

Abstract

Maģistra darba tēma ir „Laulāto līgumisko mantisko attiecību problēmjautājumi”. Šajā darbā izpētītas laulāto līgumiskās mantiskās attiecības no teorētiskās un no praktiskās puses saskaņā ar spēkā esošajiem normatīviem aktiem, tajā skaitā laulāto līgumisko mantisko attiecību nodibināšanas, grozīšanas un izbeigšanas īpatnības. Darbā analizēta ārvalstu prakse. Darba izstrādes ietvaros autore atklāja aktuālās problēmas laulāto līgumisko mantisko attiecību regulējumā, dažādu laulības līgumu noslēgšanas tiesiskās sekas, trešo personu tiesības, kā rezultātā izdarījusi secinājumus un noformulējusi priekšlikumus kā uzlabot laulāto līgumisko mantisko attiecību institūtu. Maģistra darbā tiek izmantoti sekojoši atslēgvārdi: laulātie, līgums, laulība, atsevišķa manta, kopīga manta.

A theme of a master thesis is «Problematic issues in matrimonial contracts». This study is related to particular issues associated with the common characteristics of prenuptial contracting, according to current legislation, specifics of entering into, cancellation, changing, dissolving of a marriage agreement, foreign practices are examined. During the process of work, author has revealed topical problems in regulation of property relations of the spouses, with the existance of different types of contracts and legal consequences of conclusion of them, found out the aspects of providing interests of the third parties in cases of concluding marriage agreements. As a result, author draws conclusions and formulates several propositions concerning the potential improvements of prenuptial contracting legislation.
