Tēmas aktualitāti nosaka tas, ka jau ir apritējuši vairāk kā divi gadi kopš 2010.gada 1.novembrī stājās spēkā jaunais Maksātnespējas likums, kura uzdevums ir padarīt vienkāršāku un ātrāku fiziskās personas maksātnespējas procesu. Darba mērķis ir izpētīt fiziskās personas maksātnespējas procesa bankrota procedūras īpatnības un aktuālos problēmjautājumus. Darba uzdevumi ir izvērtēt fiziskās personas maksātnespējas regulējošos normatīvos aktus, analizēt administratora, parādnieka un kreditora lomu fiziskās personas maksātnespējas procesa bankrota procedūrā. Spēkā esošais Maksātnespējas likums nesniedz risinājumus uz konstatētajām problēmām fiziskās personas maksātnespējas procesā un vietām nekonkrētais likuma regulējums ir cēlonis dažādai tiesu praksei.

The topicality of the subject stems from the fact that more than two years have passed since the new Insolvency Law took effect on November 1, 2010. The Law was designed to simplify and accelerate the insolvency process of physical entity. The goal of the paper is to explore the peculiarities and key issues of bankruptcy procedure within the insolvency process of physical entity. The objectives of the paper are to review the normative acts governing the insolvency of physical entities and to analyse the roles of administrator, debtor and creditor in the bankruptcy procedure of insolvency process of physical entity. The effective Insolvency Law does not provide for solutions of the problems found in the insolvency process of physical entity, and the uncertain regulation of the law in places is the cause of a diverse case-law.
