dc.description.abstract | 1787.gadā ASV tika pieņemta pirmā rakstiskā konstitūcija, kurā tika iestrādāti nozīmīgi konstitucionālo tiesību principi, tai skaitā varas dalīšanas princips, kuru realizēšanai ir būtiska nozīme arī mūsdienās.
Turpmāk pasaulē aizsākās strauja konstitucionālisma attīstība un svarīgākos tiesību principus, tostarp varas dalīšanas principu, konstitūcijās pārņēma arī citas valstis.
Taču tiesību recepsijas ietvaros, pazuda minēto tiesību principu izpratne un nozīme tiesiskas valsts attīstībā. Vienas valsts tapšanas laikā izstrādātie konstitucionālie mehānismi izrādījās nepiemēroti citai tiesību sistēmai.
Tā rezultātā, daudzās valstīs nav sabalansētas varu tiesiskās attiecības. Ir svarīgi aplūkot varas dalīšanas pamata nozīmi un faktisko izpausmi un, ņemot vērā tiesu praksi un zinātnes pienesumu, piedāvāt tam atbilstošu Satversmes regulējumu.

dc.description.abstract | In the year 1787, USA, was adopted the first written constitution which contains important constitutional principles, including separation of powers, of significant value even nowadays.
Further in the world began development of constitutionalism and most important principles of law, including separation of powers, were adopted in constitutions of other states.
However, in the framework of this legal reception, the meaning and conception of those legal principles in relation to further advancement of law governed state was lost. It was proven to be that constitutional mechanisms developed during formation of one state, were inappropriate for another legal system.
As a result, many states do not enjoy balanced mutual relations of state powers. It’s important to examine the main meaning and actual expression of separation of powers and considering court practice and doctrine, introduce appropriate regulation of Satversme.
