Morālā kaitējumakompensācijas dažādos noziedzīgos nodarījumos

Abstract

Maģistra darbs Morālā kaitējuma kompensācijas dažādos noziedzīgos nodarījumos ir izstrādāts ar mērķi noskaidrot, kā morālā kaitējuma institūts ir iestrādājies Latvijas Republikas tiesu praksē, un vai pastāv problēmas noteikt tā kompensācijas pēc dažādiem kritērijiem. Darba izstrādes laikā tika izpētīts gan morālā kaitējuma jēdziens, gan tā kompensācijas piemērošana Latvijā un ārvalstīs. Darba izstrādes mērķis ir izprast un noskaidrot morālā kaitējuma noteikšanas kritērijus, pēc kurām tiesneši vadās, nosakot kaitējuma kompensācijas apmērus. Lai to noskaidrotu, uzdevums ir izpētīt gan morālā kaitējuma un kaitējuma morālei jēdzienu atšķirību, kā arī kaitējuma kompensāciju noteikšanas kritērijus, kaitējumu kompensācijas noteikšanu Latvijā un ārzemēs, papildus analizēt tiesu praksi par kaitējuma kompensācijām dažādos noziedzīgos nodarījumos. Lai pilnveidotu morālā kaitējuma institūtu, autore piedāvā dažādus risinājumus, arī pilnveidot normatīvos aktus.

The Master’s Paper Compensation for moral damages in various crimes has been worked out to clarify, what is a basics of moral damages institute of jurisprudence in Latvian Republic and if there are problems to identify damage compensations by different criteria. As a result of the work is examinated the concept of moral damage and its compensation in Latvian Republic and abroad. The objective is to find out and understand the nature of moral damage criteria and as the Court of Justice, judges shall be guided in determining the amount of compensation. To clarify this, the challenge is to explore the moral and morality difference in terms of damage as well as damage compensation criteria for damage compensation for Latvian and abroad, be analyzed further jurisprudence on compensation for damage in various offenses. Institute of moral damages for the development, the author proposes variety of solutions and improve the laws and regulations to make it possible.
