Draudu tiesiskais raksturojums krimināllikumā

Abstract

Maģistra darba ietvaros analizēts jēdziens „draudi” un tas, ar kādu saturu tas ir piepildīts Krimināllikuma pantos. Jēdziens „draudi” aplūkots no vēsturiskā aspekta, kā arī tika salīdzināts ar mūsdienu tiesību normām. Pētījumā ir aplūkoti Krimināllikuma panti, kuri sava noziedzīgā nodarījuma sastāvā iekļauj norādi uz vardarbības draudiem, tomēr ar atsķirīgu formulējumu. Īpaša nozīme tiek piešķirta Krimināllikuma 132.panta noziedzīgā nodarījuma sastāva izpētei, turklāt, analīzei tika izmantota attiecīga tiesu prakse. Maģistra darba pētijumā ir iekļauts salīdzinājums arī ar ārvalstu kodifikācijām, kuros ir iekļauti citu veidu draudi.

In the Master’s Thesis, the concept of “threats” and the content which is given to it in the sections of the Criminal Law is analyzed. Concept of the “threat” is studied from the historical aspect and compared to the present-day legal provisions. In the research, the author of the thesis analyzed sections of the Criminal Law which contain reference to the threats of violence in their elements of the criminal offence, but with different wording. Special attention is paid to the research of the elements of the criminal offence defined in the Section 132 of the Criminal Law; furthermore corresponding court practice was used for the analysis. Research of the Master’s Thesis includes comparison to the foreign codifications which contain other types of threats.
