Sabiedrības tiesības uz līdzdalību ietekmes uz vidi novērtējuma procesā

Abstract

Maģistra darbā „Sabiedrības tiesības uz līdzdalību ietekmes uz vidi novērtējuma procesā” ir pētīts sabiedrības līdzdalības tiesību institūts un tā nozīme ilgtspējīgas attīstības apsvērumu integrēšanai, pieņemot plānošanas dokumentu un paredzētās darbības lēmumus. Maģistra darba ir analizēta patreizējā situācija sabiedrības līdzdalības jomā, ņemot vērā dažādus aspektus, kas nosaka un veido sabiedrības līdzdalības lomu un nozīmi lēmumu pieņemšanā. Darba autore analizē gan teorētiskos aspektus, gan problēmjautājumus, kas parādās sabiedrības līdzdalības tiesību institūta piemērošanā praksē, mijiedarbību starp iesaistīto pušu interesēm un tiesisko ietvaru nacionālā un starptautiskā līmenī. Darba autore konstatē, ka sabiedrības līdzdalība un ietekmes uz vidi novērtējums kā starpdisciplināras, starpkultūru un starpnacionālas kategorijas ir jo sevišķi pakļautas procesuālo tiesību regulējumam un mazina nenoteiktības lomu lēmumu pieņemšanā.

Master thesis „The Right of Public Participation in the Process of Environmental Impact Assessment” is a research about public participation as legal instrument and its implications in the integration of considerations of sustainable development into plan-making and projects. This thesis is intended to provide a state-of-the-field review of public participation, bringing together a wide range of perspectives that both frame and focus the ongoing discourse on its role and contribution to informed decision-making. The author analyzes theoretical aspects and problems that appear in the path of public participation in informed decision making, correlation between the interests of different stakeholders involved in the process and the legal framework in national and international level. The author reveals that public participation and environmental impact assessment must be determined through the application of procedural requirements.
