Leģisprudences iespējas likumu kvalitātes uzlabošanai

Abstract

Normatīvajos aktos ir sastopamas neprecizitātes un pretrunas, ko varēja novērst to radīšanas gaitā. Likumdevēja prioritāte ir ātri radīt jaunus normatīvos aktus, tādā veidā cenšoties raitāk atrisināt problēmas, bet no radīšanas ātruma cieš to kvalitāte. Darba mērķis ir aktualizēt leģisprudences izmantošanu likumdevēja profesionalitātes celšanā, uzlabojot normatīvo aktu kvalitāti. Darba uzdevumi ir izpētīt leģisprudences būtību, tās jēdzienu, institūcijas, kuru darbība ir atkarīga no leģisprudences, izzināt tiesību skolu ietekmi, analizēt leģisprudences principus un aplūkot Latvijas Valsts prezidenta 2012.gada 12.decembra rīkojuma Nr.7 izpildei piedāvātos risinājumus. Tika secināts, ka leģisprudence paver plašas iespējas normatīvo aktu satura un to pieņemšanas procedūras uzlabošanai. Kā vienota mācība tā pagaidām ir mazpazīstama, tomēr daudzi no leģisprudences piedāvātajiem risinājumiem jau ir iekļauti un tiek izmantoti valstu nacionālajās tiesību sistēmās.

Fundamental errors, inaccuracies and contradictions can be found in laws although they could be prevented during legislation. The priority of legislature is to create new laws trying to solve the problem as soon as possible. However, the quality of laws decreases because of hurry. The paper aims to popularize legisprudence as a tool for improving the quality of legislature’s action. The tasks of the paper is to explore nature and concept of legisprudence, to study which institutions are related with legisprudence, influence of different law schools, to analyze principles of legisprudence and to examine December 12, 2012 Order No.7 of President of Latvia and the solutions proposed. It was concluded that legisprudence offers a huge potential for improving the content of laws and legislation. Although as a single lesson so far it is still obscure some of the solutions offered by legisprudence is already included and used in national legal systems.
