Valsts meža dienests kā kompetentā institūcija un kā cietušais kriminālprocesā: pienākumu un tiesību analīze

Abstract

Tā kā Satversme garantē personām tiesības uz taisnīgu tiesu, tad ir nepieciešams izvērtēt, vai netiek nepamatoti ierobežotas minētās tiesības situācijā, kad vienai personai kriminālprocesā – Valsts meža dienestam, vienlaicīgi ir jāsniedz gan kompetents atzinums, kas pieprasa objektivitāti un neieinteresētību lietas iznākumā, gan jāpārstāv cietušais, kur šāds statuss savukārt pieprasa ieinteresētību lietas iznākumā par labu cietušajai personai. Lai sasniegtu izvirzīto mērķi tiek analizētas Valsts meža dienesta tiesības un pienākumi kriminālprocesā; tiek noskaidrots, vai situācija, kad Valsts meža dienests sagatavo atzinumu un pārstāv cietušo nerada interešu konfliktu kriminālprocesā un nepārkāpj procesuālās līdztiesības principa pārkāpumu attiecībā pret personu, kurai ir tiesības uz aizstāvību tādā mērā, ka tiek pārkāptas tās tiesības uz taisnīgu tiesu.Since the Constitution guarantees one’s rights to a fair trial, then it is necessary to evaluate if the before referred rights are not being unreasonably restricted in a situation, when one person in criminal procedure – the National Forest Service, must provide both a competent opinion, which requires objectivity and disinterest in the outcome of the case, and at the same time represent the victim, where in turn such a status requires interest in the outcome of the case in favor of the injured party. In order to achieve the proposed objective, the National Forest Service rights and obligations in a criminal proceedings were being analyzed; it is being clarified, that there is no conflict of interests or violation of principle procedural rights of equality against a person, who has rights of the defense to such an extent that violates its rights to a fair trial, in situations, when the National Forest Service issues a statement and represents the victim.
