Uzņemšana pilsonībā par īpašiem nopelniem Latvijas labā.

Abstract

Šī darba mērķis ir, pirmkārt, analizējot dažādu autoru uzskatus, noskaidrot pilsonības institūta jēdziena būtību, saturu, mērķus un tā attīstību. Otrkārt, noskaidrot patreizējā tiesiskā regulējuma vēsturisko izcelsmi. Treškārt, analizēt problēmas, kas izriet no pašreiz spēkā esošā Pilsonības likuma nosacījumiem. Ceturtkārt, apzināt šo jautājumu tiesisko regulējumu ārvalstu tiesību aktos, kas iespējams, rosinātu idejas mūsu valsts tiesību normu pilnveidošanai. Lai labāk izprastu uzstādītos mērķus, bakalaura darba ietvaros tika pētīti pilsonības institūta izveidošanās vēsturiskie apstākļi un pilsonības iegūšanas veidi, starptautiskie līgumi un citu valstu pieredze, uzņemot pilsonībā personas ar nopelniem valsts labā, analizēta mūsu kaimiņvalstu – Igaunijas un Lietuvas pieredze un prakse šo jautājumu risināšanā. Darbā apskatīti nosacījumi Pilsonības likumā un Saeimas Pilsonības likuma izpildes komisijas izveide un darbība, uzņemot personas pilsonībā par īpašiem nopelniem Latvijas labā. Pētīta īpašo likumu par Latvijas pilsonības atzīšanu nepieciešamība. Darba trešajā nodaļā apskatīta kārtība un kritēriji pilsonības iegūšanai par īpašiem nopelniem Latvijas labā, analizēti iespējamie risinājumi esošās situācijas uzlabošanai. Darba gaitā gūtie secinājumi apkopoti nodaļu beigās un secinājumos. Darbam pievienoti pielikumi, kuros norādīti likumprojektu paraugi, dokumentu kopijas un citi materiāli, kas tiek izmantoti Pilsonības likuma izpildes komisijas darbā. Bakalaura darba apjoms ir 45 lappuses, tas sastāv no 3 nodaļām, 9 apakšnodaļām un 12 pielikumiem.

Aim of this Batchelor Paper is to, firstly, analyzing opinions of various authors, to define the essence, contents, targets and development of the concept of the citizenship institute. Secondly, to clarify the current legal framework for the historical origins. Thirdly, analyze the problems arising from the current Citizenship Law. Fourthly, to realize legal regulation of this aspect according to the foreign laws that would probably help to find the ways for improvement of our state legal norms. In order to understand the targets set forth respectively, the historical circumstances for creation of the citizenship institute and ways or obtaining citizenship, international treaties and experience of other states, granting citizenship to the persons rendered special services of state are researched in the framework of the Batchelor’s Paper, analyzing experience of our neighboring states – Estonia and Lithuania – and their practice in handling such issues. The paper deals with the conditions of Citizenship Act and the Citizenship Law enforcement parliamentary commission the creation and operation of the receiving person's citizenship on the special merits in favor of Latvia. The necessity of adoption of special laws on granting Latvian citizenship is researched. The third part of the Batchelor paper contains the procedure and criteria for obtaining citizenship for special services for Latvia, analysis of possible solutions for improvement of the current situation. Works over the conclusions are summarized at the end of chapters and the concluding section. Work attached annexes, which set out the bill samples, copies of documents and other materials used in the Citizenship Law enforcement commission work. The Batchelor Paper consists of 45 pages, comprising 3 parts, 9 subparts and 12 annexes.
