Bakalaura darba ‘’Slepkavība, pārkāpjot nepieciešamās aizstāvēšanās robežas’’ aktualitāte ir pamatojama galvenokārt ar to, ka valsts drošības līdzekļi ne vienmēr spēj nodrošināt pilnīgu personu drošību, līdz ar to ir gadījumi, kad ir nepieciešams pielietot nepieciešamo aizstāvēšanos. Vienmēr pastāv iespēja, ka nepieciešamās aizstāvēšanās līdzekļu pielietošana var neatbilst uzbrukuma bīstamībai un iestājas nepieciešamās aizstāvēšanās ekscess , kā augstākā pakāpe ir cilvēka slepkavība. Bakalaura darba mērķis ir iegūt padziļinātu priekšstatu par nepieciešamās aizstāvēšanās būtību, mērķi un samērību, kā arī par slepkavības, pārkāpjot nepieciešamās aizstāvēšanās robežas, būtību. Darbs sastāv no 3 nodaļām, kuru ietvaros tiek izpētīta slepkavības, pārkāpjot nepieciešamās aizstāvēšanās robežas, vēsturiskā attīstība, Krimināllikuma 121. panta sastāvs, kā arī ārvalstu regulējums, kas attiecas uz slepkavību, pārkāpjot nepieciešamās aizstāvēšanās robežas. Darba mērķa un uzdevumu realizācijai autors izmanto tādas metodes, kā literatūras apkopojums un analīze, tiesu prakses analīze un salīdzināšana ar citu valstu pieredzi. Darba rezultātā tika iegūts priekšstats par slepkavības, pārkāpjot nepieciešamās aizstāvēšanās būtību, aizstāvēšanās ekscesu – nepieciešamās aizstāvēšanās robežu pārkāpšanu, kā arī tika izzināti Krimināllikuma 121. panta piemērošanas pamatprincipi Latvijā. Each and every person has its rights to live as well as rights to the necessary self defense. In court practice of various countries its pretty common to come across the cases where an individual exceeds his rights to self defense causing death of his offender. Therefore almost every country has a law by which such act is considered. The main aim of the Barchelor’s work ‘’Murder, by exceeding necessary defense’’ is to determine the definition and nature of the term necessary defense as well as the analysis of court practice involving the conviction for the murder, by exceeding necessary defense.
The work consists of 3 parts. The first part is devoted to research of history about necessary defense as well as the nature of necessary defense and murder by exceeding necessary defense. The second part also consists of the analysis of the court practice involving the situations where it is necessary to determine whether or not the person was in a state of the necessary self defense. The third part is devoted to the comparison of the necessary defense definiton in various countries and also to the comparison of the sanctions that are enforced if the individual is convicted for the murder by exceeding the necessary defense.
