Franšīzes līgums

Abstract

Bakalaura darba "Franšīzes līgums" mērķis ir jaunā nacionālā tiesiskā regulējuma izpēte, tā atbilstības starptautiskajam regulējumam konstatēšana. Bakalaura darbs sastāv no četrām nodaļām, kurās tiek aplūkots franšīzes līgums un tā būtība, tā atšķirība no citiem civiltieskiem līgumiem, franšīzes attīstība Latvijā un tiesiskā regulējuma pilnveidošana Eiropas Savienības tiesiskā regulējuma ietvaros, kā arī problēmjautājumi un to risinājums. Darba autors nonāk pie secinājuma, ka nolūkā pastiprināt franšīzes ņēmēja tiesisko aizsardzību Komerclikumā būtu jāpastiprina franšīzes ņēmēja tiesiskā aizsardzība. Tiesiskais regulējums attiecībā uz franšīzes līgumu atbilst starptautiskajās tiesību normās noteiktajam regulējuma minimumam.

The theme of my diploma work is "Franchise Agreement". The author wanted to focus increasing role of franchising in commercial environment. Analyze and determine Latvia's new legal framework, its compliance with international law. Diploma work is to find out franchise agreement term contractors and their responsibilities, types of contracts and contractual implications. At the same time author discovered contract differences from other similar civil contracts. The result is an open legal problems and possible solutions. Author has concluded that the commercial law which includes franchise agreement meets minimum of international regulation. Author suggests that Commercial law should be improved in addition to determine the obligations, borders and points of franchisor.
